Three people have died in a Bakersfield car accident, which was caused by a suspected drunk driver. According to a news report in the Bakersfield Californian, Herculano Hernandez, 23, was speeding east toward Delano on Highway 46 in a 2000 Ford the morning of January 1, 2010 when he rear-ended a Honda driven by 21-year-old Richard Jung. The Honda then crossed lanes into the path of a 2008 Chevy pickup driven by Carl Logan, 71, and the two vehicles crashed head-on. Jung and his mother, Hyun Kim, 49, who was a passenger in the Honda, both died at the scene. Logan and his wife Vivian Logan, 69, were taken to a hospital in critical condition. Carl Logan died later. Vivian Logan remains in serious condition with major injuries. Hernandez has been arrested on suspicion of DUI and vehicular manslaughter. He was uninjured.
I offer my deepest condolences to the families here that have lost their loved ones apparently due to the negligence and recklessness of one person. My heart goes out to the families and friends of Carl Logan, Hyun Kim and Richard Jung for their tragic and heartbreaking loss. Please keep these victims and their grieving families in your prayers.
Car Accident Fatalities
According to the news report, Carl Logan's death moves up the tally of fatalities on Highway 46 in Kern County over the past three months to 10. A $216 million project to widen Highway 46 to four lanes from Interstate 5 to the Kern County/ San Luis Obispo border is underway. In Kern County as a whole, 42 fatalities and 507 injuries were reported in 2007 as a result of alcohol-related DUI car accidents, according to California Highway Patrol's traffic accident statistics.
Drunk Driving Laws in California
Driving under the influence is a serious crime under California Vehicle Code Section 23152 (a). If the act of driving under the influence results in fatalities, the drunk driver could also be charged with vehicular manslaughter (California Penal Code Section 191.5). In this particular case, the victims and their families would be well-advised to seek the legal counsel of an experienced California personal injury lawyer who will analyze all aspects of this accident and make sure that they get fair compensation for their injuries, damages and losses.
Claim for Compensation
Where negligence or wrongdoing is involved, families of deceased car accident victims can file a wrongful death claim seeking compensation to cover medical or funeral expenses, loss of future earnings, loss of love and companionship and other related damages. A knowledgeable car accident lawyer will also be able to advise families about how their car insurance policy applies to a case where the at-fault driver is uninsured or underinsured.
