San Bernardino Fatal Car Accident
Isaac Rodriguez, 21, was killed in a San Bernardino car accident after the vehicle he was in was broadsided by a speeding car the night of February 28, 2010. According to a news report in the Victorville Daily Press, Rodriguez was driving a silver Toyota west on Baseline Street near Palm Avenue. He was trying to make a left turn when his car was struck by a Honda driven by 26-year-old Dolores K. Armendarez. Officials say that Armendarez was going at a high rate of speed. The impact from the crash split the Toyota in half. Rodriguez died at the scene. Armendarez and her passenger sustained minor injuries. No arrests have been made pending an investigation.
My heart goes out to everybody who knew and loved Isaac Rodriguez. Apparently, he leaves behind a young child. Tragic! Please keep his grieving family in your thoughts and prayers.
Car Accident Statistics
According to California Highway Patrol's 2008 Statewide Integrated Traffic Records System (SWITRS), there were four deaths and 76 injuries involving car accidents in Highland. Countywide, 263 fatalities and 8,504 injuries were reported as a result of car accidents during the same year.
Speed Law
Based on this news report, Armendarez was speeding right before she struck Rodriguez. It's not clear what the speed limit on that roadway was, but based on the intensity of the impact and police reports it appears that Armendarez may have been in violation of the Basic Speed Law. California Vehicle Code Section 22350 states: "No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic and on surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property."
Claim for Compensation
If I were a member of Rodriguez's family, I would also want to know whether Armendarez was driving under the influence or if she was distracted at the time of the accident. Where negligence or wrongdoing is involved, family members of deceased car accident victims can file a wrongful death claim seeking compensation to cover funeral expenses, lost future earnings, loss of love and companionship, and other related damages. An experienced California personal injury lawyer will be able to guide victims' families through these complex legal processes and help them secure fair compensation for their losses.
