Fatal San Francisco Bicycle Accident Involves Muni Bus

A bicyclist who was fatally injured in a San Francisco Muni bus accident the evening of October 7, 2010 has been identified as 22-year-old Derek Allen. Bay City News reports that the deadly bicycle accident happened near the intersection of Sixth Avenue and Geary Boulevard when Allen's bicycle was struck by a Muni bus. Both the bus and the bicycle were northbound on Sixth. Allen died from his injuries. An investigation is ongoing.

My heartfelt sympathies go out to everyone who knew and loved Derek Allen. Please keep this grieving family in your prayers.

Accidents Involving San Francisco Muni Vehicles

Over the last several months, we've been seeing more and more of these accidents involving Muni vehicles and other cars, pedestrians or bicycles in San Francisco. Recent statistics by the National Transportation Safety Board (NTSB) showed that accidents involving Muni vehicles are in fact on the rise in San Francisco. According to California Highway Patrol's 2008 Statewide Integrated Traffic Records System (SWITRS), there were three fatalities and 471 injuries involving bicycle accident in the city of San Francisco.

Causes and Compensation Issues

Initial official reports apparently show Allen may have entered the path of the bus. However, I trust officials are also looking into whether the bus driver's negligence or a dangerous roadway condition may have caused or contributed to the fatal bicycle accident. If it is determined that the bus driver was at fault, then, he and his employer could be held liable for Allen's wrongful death.

A skilled San Francisco personal injury lawyer will also be able to determine whether a dangerous condition on the roadway caused this accident, then, the city or governmental agency responsible for maintaining the roadway could be held liable as well. Any claim against a California public entity must be properly filed within six months of an incident.
