Two Children Die in DUI Drowning Accident

August 18, 2012—Chula Vista, CA—According to CBS News, a driver who was allegedly under the influence caused a car accident that resulted in the death of two five-year-old girls, one of them her child.

Arlene Hernandez, 22, pled not guilty to manslaughter after she drove a vehicle into a 30-foot-deep reservoir, causing the drowning of her daughter, Lesette Silva, and Guiliana Figueroa, her daughter’s friend. Hernandez and Eric Figueroa, father of the second child, escaped without injury.

The accident occurred on Otay Lake Road when Hernandez lost control of her Kia Sedona. The car flipped and slid into the reservoir near the US Olympic Training Center. The two girls were restrained in the back and were unable to escape the car. They were transported to a nearby hospital and were pronounced dead on arrival.

My heartfelt sympathies go out to the families of both of these children.

Accident Statistics Involving Drowning

Although the National Highway Traffic Safety Administrations FARS or Fatal Analysis Reporting System Database does not segregate deaths caused by drowning in motor vehicles, a recent study by Rory Austin of the NHTSA notes that there were at least 384 verifiable drowning deaths in motor vehicles in the three years between 2004 and 2007.

It is very likely that drowning was a contributing factor in many other accidents; for example, if the victim drove into a lake and was rescued prior to drowning, but later died from complications of the accident such as pneumonia, it is unlikely that this information would appear in the data published by the agency.

California had the second-highest rate of car accident drowning, just behind Florida and just ahead of Texas.

Could This Accident Have Been Prevented?

Although the investigation into the accident continues, it appears that the driver was intoxicated at the time of the accident. It is impossible to say that the accident would not have happened if she had been sober, or that she would have been able to render aid to the children if she was not drinking. However, statistics tend to show that people who are under the influence of alcohol have much slower reaction times and are unable to plan clearly when faced with an emergency, so it is likely that this senseless tragedy was as much the result of alcohol as the circumstances of the accident.

Liability Issues

Whether or not the driver is convicted of manslaughter, she is liable for the death of the little girls in the car and injuries to her passenger. A professional car accident attorney should examine the facts of this case and determine the best way to recover damages.

Motorcyclist Dies in A Collision With Vehicle

August 16, 2012—Lake Forest, CA—According to the Orange County Register, a 29-year-old man was killed when his motorcycle collided with an Acura making a left turn in front of him.

The accident occurred on Peachwood Street at Palmwood Drivejust after 12:00 noon. The motorcycle rider was traveling east on Peachwood when the driver of an Acura sedan turned left in front of him. The rider struck the door and was ejected from the bike. He was pronounced dead at a local hospital. Authorities have not released his name pending notification of his relatives.

No arrests have been made, but the major accident reconstruction team is currently investigating the collision.

My sincere condolences go out to the family of this unfortunate victim.

Accident Statistics

About two-thirds of all motorcycle accidents are the fault of a passenger car driver, according to the Insurance Institute for Highway Safety. Of those accidents, fully half involve a driver making a left-hand turn in front of an oncoming motorcycle rider.

It is unclear why this phenomenon occurs so often. Some experts have speculated that the smaller size of a motorcycle when compared to a passenger car creates an illusion that causes drivers to believe they have more turning space than they actually do.

What Happened In This Accident

While it is clear that the driver turned left in front of the motorcycle rider, the question of fault still must be answered. It is possible that the motorcycle rider was running a red light, although that does not seem to be indicated from the initial accident reports. It is possible that there may be some other explanation for the accident. If so, the accident reconstruction team should be able to offer other possible scenarios that may have led up to this crash and might help determine where true liability lies in this accident.

Liability Issues

The driver of the Acura sedan, if charged with the accident, could face a wrongful death suit brought about by the victim’s family for their loss. Wrongful death suits imply that there was a gross amount of negligence on the part of the defendant; in this case, that assumption would rest on the fact that the driver pulled out in front of the oncoming motorcycle and caused him to crash, ultimately leading to his death.

If you have an accident with a motorcycle in the Southern California area, you need to get in touch with an Orange County Motorcycle Accident Lawyer today.

Oil Spill Results In Clogged "Arteries" on Freeway

July 30, 2012-Santa Ana, CA-Southbound I-5 was closed all morning Saturday due to an
unusual "oil spill" on the highway.

California Highway Patrol reports that around 6:00 a.m., a large truck carrying boxes of
canola cooking oil dropped its cargo across the highway near Southbound 55, spilling
gallons of the oil across the highway.

Apparently not realizing that the oil had been spilled, the truck driver kept traveling,
leaving behind the slick mess that other drivers quickly plowed into, skidding off the
road and onto medians and shoulders.

Fortunately, no one was seriously injured in the accidents, although several cars were
damaged. Caltrans soon arrived with super absorbent substances to soak up the oil.

However, lanes remained closed and traffic clogged the freeways until at least 10:30 a.m.
that morning.

My sincere wishes for a speedy recovery to any of the victims who suffered minor
injuries, and my congratulations to all the drivers on avoiding serious injury.

Accident Statistics

Spills with large trucks are not uncommon on our highways. According to the United
States Department of Transportation, in 2007 there were 2,250 dangerous spills on
highways as opposed to only a handful in the air, on the water, and by rail combined.

Transporting goods by highway remains the most potentially dangerous way of moving
dangerous materials because of the crowded conditions of most roads and the potential for
serious accidents.

What Happened In This Accident

Fortunately, this accident seems more comical than frightening. Although the potential
for serious injury was present, only minor injuries and some property damage resulted.

However, when considering the potential for a very serious and dangerous situation, this
accident becomes far more sobering. If the substance on this truck had been a hazardous
chemical or dangerous material, this accident could have resulted in numerous injuries
and even deaths. The area around this very busy intersection could have been shut down
for a long period of time, strangling traffic patterns in Orange County. The potential
for serious damage and loss is very high.

Liability Issues

The truck driver may have liability for this accident if the spill was caused by his or
her negligence. However, the owner of the cargo may also have liability, as well as the
people who loaded the truck in such a way that the spill occurred. The State of
California or City of Santa Ana may also be liable if it can be shown that something in
the roadway caused the spill.

If you encounter a situation that results in an accident due to someone else's
negligence, you need to call Santa Ana Truck Accident Lawyers at 800-561-4831. We
have over 30 years of experience in the complex California truck laws and can send
investigators out in as little as an hour to the scene of the truck accident in Santa
Ana. We're here to help.
