The Press-Enterprise reports that Graves was driving east on Florida Avenue near Hemet, in a Chevy Malibu, when the car crossed into opposing lanes and struck a Honda Accord. Huizar, the driver of the Accord, died at the scene. Dakota sustained critical injuries and died at a local hospital. Graves' injuries were also fatal. He was apparently not wearing a seatbelt, but Dakota was buckled into a backward facing car seat.

My heart goes out to the family and friends of Donald and Dakota Graves as well as Andrew Huizar. I offer my deepest condolences to everyone who knew and loved these deceased victims. Please keep them in your prayers.

Car Accident Statistics

According to CHP's 2008 traffic accident statistics, there were seven fatalities and 416 injuries involving car accidents in Hemet. In Riverside County as a whole, car accidents claimed 220 lives and injured 8,561 people in 2008.

How Did this Fatal Collision Occur?

Based on the details of this news report, authorities are still not sure what caused this tragic accident. However, they are saying at this point that an unsafe turning maneuver by Graves on the straight stretch of Highway 74 may have caused this head-on collision. Both cars were apparently traveling at about 55 mph. Neither driver was intoxicated, officials said.

Fault and Liability Issues

In such cases, it is best for families of the deceased victims to seek the counsel of an experienced Riverside personal injury lawyer who will stay on top of the official investigation and help protect their legal rights and options. If Graves is determined to have been at fault for this accident, then Huizar's family may be able to seek compensation from Graves' estate and insurance. If Huizar was at fault, the Graves family can seek compensation from Huizar's estate and insurance. A knowledgeable car accident attorney will also be able to advise victims' families about how their own car insurance policy applies to a case where the at-fault driver is uninsured or underinsured.

Gregory Valenzuela, 22, Raoul Perez, 23, and Manuel Ruiz, 25, were all killed in a Sacramento car accident after the vehicle they were in collided with another near the intersection of Cosumnes River Boulevard and Center Parkway early morning on March 6, 2010. According to a KCRA News report, 25-year-old Omar Carrasco was arrested on suspicion of felony hit-and-run charges since he fled the scene of the crash on foot. Officials said the collision occurred between a Lincoln driven by Carrasco and an Acura. Police are also saying that one of the vehicles ran a red light.

Hit-and-Driver Just Got His License Back

Carrasco apparently just had his license reinstated two days before this fatal crash. He had had his license suspended five times since 2007 for a drunk driving offense, failure to appear for a DUI notice, not completing a DUI treatment program and canceling his auto insurance. Officials said Carrasco was found much later on the day of the crash, at a hospital being treated for injuries he had sustained in the crash.

What Caused this Fatal Collision?

I offer my deepest condolences to everyone who knew and loved Valenzuela, Perez and Ruiz for their devastating loss. Please keep them in your thoughts and prayers.

Based on this news report, it is not clear whether Carrasco was under the influence at the time of the crash. Officials are also looking into who failed to yield right-of-way at the intersection and caused the collision. If Carrasco is determined to have caused the accident by running a red light, he could be looking at serious criminal charges and civil liability in this hit-and-run car accident. In addition, he fled the scene of an accident, which is a felony offense.

Laws and Liability Issues

Hit-and-run is a serious crime in California. According to California Vehicle Code section 20001: "The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident."

The victims' families in this case would be well-advised to seek the counsel of an experienced Sacramento personal injury lawyer who will analyze all aspects and make sure that the negligent parties are held responsible. Given Carrasco's driving record, I doubt he had any car insurance coverage. A knowledgeable car accident lawyer will also be able to advise families about how their car insurance policy applies to a hit-and-run case or to an incident where the at-fault motorist is uninsured or underinsured.

According to a news report in The San Diego Union-Tribune, the fatal accident occurred the afternoon of March 7, 2010 on Wildcat Canyon Road, near Muth Valley Road. California Highway Patrol officials said the driver of a 2004 Ford F-150 was driving at a high rate of speed on a slick roadway, when he lost control and collided head-on with a Plymouth Voyager minivan. The Ford's driver and his son were uninjured. The driver of the minivan sustained moderate injuries while her 62-year-old passenger died. Officials believe that the passenger was not wearing a seatbelt.

My heart goes out to the deceased victim's family and friends for their devastating loss. I offer my deepest sympathies to everyone who knew and loved this man. Please keep them in your prayers.

Car Accident Statistics

According to CHP's traffic accident statistics, there were 81 fatalities and 6,123 injuries involving car accidents in San Diego in 2008. Countywide, car accidents claimed 246 deaths and injured 13,527 people during the same year.

Fault and Liability Issues

If the details of this news report are accurate, it appears to me that the driver of the Ford F-150 may have been traveling at a unsafe rate of speed given the wet roadway conditions. If the driver of the pickup is determined to have been at fault, he could be held liable for the injuries caused to the driver and passenger of the minivan. I trust officials are also looking into whether the driver of the Ford was impaired, distracted or otherwise negligent in this case. Where negligence or wrongdoing is involved, families of deceased car accident victims could file a wrongful death claim seeking compensation to cover medical/funeral expenses, lost wages, loss of love and companionship, and other related expenses.

If I were a member of the deceased victim's family, I would also want to confirm if his injuries were in fact, the result of her not wearing a seatbelt or because of a seat restraint system failure. An experienced San Diego personal injury lawyer, who has successfully handled seat restraint system failure cases, will be able to help this family make a determination as to what happened here. The Victorville Daily Press reports that the accident occurred on Baseline Street in Highland. Rodriguez was driving a Toyota west on Baseline and was attempting to make a left turn when a Honda driven by 26-year-old Dolores K. Armendarez broadsided his car. The impact from the collision apparently sliced the Toyota in half. Rodriguez was pronounced dead at the scene. Armendarez and her passenger suffered minor injuries. She has not been arrested because an investigation is ongoing. But officials say Armendarez was speeding right before the collision.

I offer my deepest condolences to the family and friends of Isaac Rodriguez for their tragic and heartbreaking loss. They will certainly be in my prayers.

Car Accidents

There were four deaths and 76 injuries involving car accidents in Highland, according to California Highway Patrol's 2008 Statewide Integrated Traffic Records System (SWITRS). In San Bernardino County as a whole, 263 fatalities and 8,504 injuries were reported as a result of car accidents during the same year.

Basic Speed Law

California Vehicle Code Section 22350 (Basic Speed Law) states: "No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic and on surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property." If the details of this news report are accurate, Armendarez was speeding prior to striking the Toyota. I trust investigators are looking into how fast she was going at the time of the crash and also whether she was in violation of other traffic laws.

Liability Issues

There are more questions here, about Armendarez. Was she impaired? Was she distracted at the time? Was she driving recklessly? If Armendarez is determined to have been at fault for this accident, then she could be held liable.
Six people were killed in a tour bus accident early morning on March 5, 2010 after the bus struck another passenger vehicle and rolled over on the Interstate 10 south of Phoenix. According to an Associated Press news report, at least 15 others were injured including two 11-year-olds and a 16-year-old. Two men and four women were killed. The bus was carrying 21 passengers. Officials said the bus was westbound on the interstate when the driver lost control, went off the roadway and rolled over.

My heart goes out to the family and friends of the six deceased victims in this crash. I offer my deepest condolences to everyone who knew and loved them. My thoughts and prayers are also with the 15 injured victims. I wish them the very best for a quick and complete recovery.

What Caused this Tragic Accident?

Based on the initial information available, it is not very clear what caused the bus driver to lose control of the vehicle. There are still several unanswered questions. Was the driver under the influence? Did the driver fall asleep at the wheel? Was there some type of vehicle defect or mechanical malfunction in the bus that caused the driver to lose control? I trust officials are carefully examining these and other aspects of the case in order to determine exactly what caused this accident.

Liability Issues

Bus companies -- whether private or public -- owe their passengers the standard of "the utmost duty of care." That means that these carriers are responsible for the safe transportation of their passengers. Their duty to passengers supersedes everything else. So, in this case, if this bus accident was caused by the bus driver’s negligence or error or the operator’s failure to properly maintain the bus, then the driver and his employer, the bus company, could be held liable for the accident, injuries and fatalities. If the accident occurred because of a product defect, then the manufacturer of the bus could also be held liable.

Skilled Arizona Personal Injury Lawyers

Victims of this accident would be well-advised to contact Phoenix personal injury lawyers Mark and Alexis Breyer to find out more information about their legal rights and options. I know the Breyers personally. There is no doubt these are attorneys I would recommend to anyone in this accident or the families of those killed in this accident. In such cases, remember that if the bus driver is determined to have been at fault the bus company could be held liable. Also, if you are a victim or have lost a loved one, remember not to make statements, sign agreements or talk to adjusters or attorneys for other parties before talking to your own attorney, who will look out for your rights and best interests.

Four people including an infant were seriously injured in a San Francisco car accident, which officials say was caused by a suspected drunk driver. According to an ABC News report, 24-year-old Faustino Vega-Xicohtencatl was traveling west in a 2004 Ford F-150 on Mark West Springs Road near Santa Rosa, when the crash occurred the evening of March 2, 2010. Vega-Xicohtencatl crossed into the eastbound lane and hit a 2002 Mercury Mountaineer driven by 21-year-old Carron M. Boyd, head-on. The driver of a Chevy Cobalt, Marty Lee Nelson, 52, who was behind Boyd, attempted to avoid the crash, but struck debris on the roadway.

Serious Injuries

Boyd was transported to a local hospital with major head injuries and is reported to be in critical condition. Randal C. Hinojosa, 22, a passenger in the Mercury suffered minor injuries. His 8-month-old daughter, Allesandrya Hinojosa, sustained severe head injuries and was taken to a local hospital. Nelson was uninjured. Vega-Xicohtencatl was arrested on suspicion of two charges of felony DUI and driving without a license.

My heart goes out to the family of Baby Allesandrya for what they are going through right now. I wish the child and the severely injured Carron Boyd the very best for a speedy and complete recovery. Please keep them in your prayers.

Alcohol Related Crashes

There were five fatalities and 98 injuries reported as a result of DUI collisions in Santa Rosa, in 2008, according to CHP's traffic accident statistics. In Sonoma County as a whole, 17 deaths and 264 injuries occurred due to alcohol-related crashes in 2008.

Laws and Liability Issues

Under California law, driving under the influence is a serious crime. According to California Vehicle Code Section 23152 (a): "It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle."

In such cases, it would be in victims' best interests to contact a reputedSan Francisco personal injury lawyer who has an excellent track record of holding drunk and negligent drivers accountable. In this case, it has been reported that Vega-Xicohtencatl did not have a license. It would be reasonable to assume that he does not have car insurance either. In such cases, a knowledgeable car accident lawyer will be able to advise victims about how their own car insurance policies apply to accidents involving uninsured or underinsured motorists.

Two drivers were injured in an Orange County car accident after their vehicles crashed at an intersection in La Palma. The Orange County Register reports that the accident occurred at the intersection of La Palma Avenue and Walker Street when a Honda Ridgeline collided with a Honda Civic the afternoon of March 2, 2010. Both drivers were taken to a local hospital for treatment of their injuries.

I'm relieved to read that neither driver sustained major injuries in this car accident. I wish them both the very best for a speedy and complete recovery.

Car Accident Statistics

According to California Highway Patrol's 2008 traffic accident statistics, there were no fatalities, but 77 injuries involving car accidents in La Palma. In Orange County as a whole, 152 fatalities and 13,414 injuries were reported as a result of car accidents during the same year.

Street Intersection Accidents

Based on this news report it is not clear how or why this accident may have occurred. A number of car accidents at intersections occur when one driver is attempting to make a turn. Intersection accidents also occur because one driver may have failed to yield right-of-way or tried to "make it" through the light and in the process, may have run a red light. In such cases, the at-fault party can be held liable for the accident and resulting injuries.

California law is very specific about the requirements for drivers making a left turn or a U-turn. California Vehicle Code Section 21801 (a) states: "The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety."

Contacting an Experienced Personal Injury Lawyer

Injured victims in such cases where negligence may be involved would be well-advised to contact an experienced Orange County personal injury lawyer, who will analyze all aspects of the accident and make sure that their legal rights and best interests are protected. Victims could seek compensation to cover medical expenses, loss of wages, cost of physical therapy and other related damages.

The prosecution is one of the two sides in court responsible for presenting a particular case against an individual or organization for breaking the law as part of a criminal trial. The prosecution can also be understood as the role of the government in the criminal justice system and the prosecutor is an individual, more specifically, a lawyer who works for the government and who develops the government’s case against the individual or party suspected of the crime. A prosecutor will normally investigate and arrest or charge an individual and bring the individual to trial. Since a prosecutor is responsible for targeting the defense side, you can assume that the prosecution in a DUI case will be experienced and knowledgeable about drunk driving laws and cases in your particular State.

A prosecutor will generally be approached by the police who have arrested you and investigated your DUI case so far. A prosecutor will generally consider the policy considerations, the solidity of the case and whether it can be proved or not before going ahead with the case. If the prosecutor decides not to go ahead with the DUI case, it will usually be over. It is very important, for the prosecutor to have some sort of assurance that there is sound evidence present against the defendant. For example, if the results of the breath test are not reliable or sound or have been lost; then the prosecutor will thoroughly reconsider the case before going ahead with it in the absence of a crucial piece of evidence.

Initiating a DUI Case

In order to initiate the process of a DUI case, the prosecutor will file a complaint and he or she will also be present in court at the defendant’s hearing before a judge. At times, if the defendant is being bailed, the prosecutor will have a say in that as well; if he or she has no objection to the bail, it will be allowed. When the trial starts, it will be the prosecutor who will be required to go first and present the government’s case against the defendant, providing all facts and allegations. The prosecutor will also be required to present evidence against the defendant and prove, beyond doubt, using competent witnesses that the defendant was in fact drunk driving. Usually, the arresting police officer or the one who performed the breath test will be the key witness for the prosecution. Apart from this, the prosecutor may also have other responsibilities with regard to the defendant’s DUI case. These responsibilities may vary from State to State and even from court-house to court-house.

Defending your DUI charge

Remember, that if you have been charged with DUI in any State, then it is imperative to have the best DUI lawyer who can educate you about all sorts of DUI laws and practices in that State. Moreover, your DUI lawyer should also be able to give you information about the role of the prosecution in your DUI case. If you and your DUI lawyer wish to win your case, then you need to know and understand your prosecution, who will be employing all legal methods and evidence to make sure you are penalized. Don’t, in any way, think that the prosecution is the government’s representative and can be weak in any form because the fact is that, the prosecution can have a lot of power to influence court trials especially in the case of drunk driving.

The prosecution represents the government in court, they pursue a DUI conviction with all their expertise and experience, and they investigate a case thoroughly and fish for all sorts of evidence against the offender that can be presented in court. The prosecution can also recommend a particular sentence for the defendant if he or she is found guilty of DUI.

Therefore, if you have been charged with DUI in your State, then the best thing you can do for yourself, is to ensure that you have the best possible protection, against the prosecution. That is, you hire an experienced and knowledgeable DUI lawyer in your State, one who can help you with the details of your case and guide you throughout the trying experience of the DUI trial. Your DUI lawyer should also be able to represent you in court successfully and present a convincing case in your favor.
According to news reports, Masson Blow was speeding and lost control of his Volkswagen Passat crashing head-on into the vehicle carrying Vermillion, Treen and their 1-month-old daughter Jenna, who survived but sustained permanent injuries in the April 2009 crash. You can read more about the accident from our previous post, "San Luis Obispo DUI Car Accident Kills One". Initial news reports suggested alcohol may have been involved, but later reports corrected that information. Alcohol was not a factor in this collision, officials determined.

Blow initially pleaded not guilty to two felony counts of vehicular manslaughter and one misdemeanor count of reckless driving causing injury, but in November, changed his plea to no contest. Officials had said that alcohol was not a factor in the crash, but that Blow was traveling at a high rate of speed and had lost control of his vehicle. Blow apparently expressed remorse and was tearful at the recent sentencing hearing.

Tragic Car Crash

My heart goes out to baby Jenna, who has apparently sustained catastrophic injuries in this crash. The nature and extent of her injuries are not clear, but it is clear that they are "permanent injuries." One can only hope that this child, who lost both her parents in that car accident, is being cared for by loving family members. Jenna will be in my thoughts and prayers.

This tragic car accident is a lesson and a reminder to all of us to drive safely and carefully. A momentary lapse in judgment can turn lives upside down. A young child is now permanently injured and growing up without parents. Blow, a student who was attending California State University in San Luis Obispo at the time, will now have to spend a year in jail and will have a criminal record. This is clearly a no-win situation for everybody involved and a true tragedy.

Getting the Help they Need

Jenna Vermillion's family members have hopefully contacted an experienced
California personal injury lawyer to help secure the young child's future. As personal injury attorneys who have represented catastrophically injured children, we know and understand the challenges faced by family members who are left responsible for their care. In such cases, families are able to seek compensation to cover medical expenses, cost of hospitalization, rehabilitation, therapy and the cost of long-term care. Some patients require 24/7 care and extended rehabilitation.

According to a news report in the Victorville Daily Press, Rodriguez was driving a silver Toyota west on Baseline Street near Palm Avenue. He was trying to make a left turn when his car was struck by a Honda driven by 26-year-old Dolores K. Armendarez. Officials say that Armendarez was going at a high rate of speed. The impact from the crash split the Toyota in half. Rodriguez died at the scene. Armendarez and her passenger sustained minor injuries. No arrests have been made pending an investigation.

My heart goes out to everybody who knew and loved Isaac Rodriguez. Apparently, he leaves behind a young child. Tragic! Please keep his grieving family in your thoughts and prayers.

Car Accident Statistics

According to California Highway Patrol's 2008 Statewide Integrated Traffic Records System (SWITRS), there were four deaths and 76 injuries involving car accidents in Highland. Countywide, 263 fatalities and 8,504 injuries were reported as a result of car accidents during the same year.

Speed Law

Based on this news report, Armendarez was speeding right before she struck Rodriguez. It's not clear what the speed limit on that roadway was, but based on the intensity of the impact and police reports it appears that Armendarez may have been in violation of the Basic Speed Law. California Vehicle Code Section 22350 states: "No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic and on surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property."

Claim for Compensation

If I were a member of Rodriguez's family, I would also want to know whether Armendarez was driving under the influence or if she was distracted at the time of the accident.
Los Angeles Car Accidents

According to CHP's 2008 Statewide Integrated Traffic Records System (SWITRS), there were 268 fatalities and 25,588 injuries involving car accidents in Los Angeles. Countywide, 667 fatalities and 52,229 injuries were reported due to car accidents during the same year.

How Did this Accident Occur?

This news report does not provide information on how or why this multi-vehicle collision took place. There are several questions here that have not been answered. Who caused the accident? How exactly did it occur? Was one of the drivers impaired, distracted, speeding or otherwise negligent at the time? Was anyone else injured in this crash? I trust CHP investigators are examining all these issues and more in order to determine exactly what happened in this case.

Claim for Compensation

In any case that involves multiple vehicles and victims, the investigation can be complex simply because there are usually multiple accounts of what happened. In such cases, it is advisable for those injured in the accident or their families, to avoid talking to insurance adjusters or attorneys for other parties. It is also important to remember not to sign any documents or forms you get in the mail from insurance companies. You don't want to sign your rights away.

Also, do not enter into any agreement or accept any settlement until you have talked to an experienced Los Angeles personal injury lawyer. In any case that involves negligence or wrongdoing, families of deceased car accident victims can file a wrongful death claim seeking damages to cover funeral expenses, lost future earnings, loss of love and companionship, and other related damages. The best personal injury law firms will always offer a free and comprehensive consultation to injured victims and their families.

Two people were hospitalized with injuries after a San Bernardino car accident, which involved five vehicles. According to a news report in the Victorville Daily Press, the accident occurred the afternoon of February 25, 2010, when a blue Honda driven by Jerimiah DeGrandis and heading west on Bear Valley Road, near Cobalt Road, swerved suddenly and was hit on the passenger side. A silver Ford pickup truck traveling behind the Honda then swerved into oncoming traffic, colliding head-on with a BMW heading east and driven by Corey Lathrop, 21. Two other vehicles that were following the BMW were also involved in the collision. DeGrandis and the driver of the Ford truck were transported to a local hospital for treatment of their injuries. Officials are still trying to determine what caused the Honda to swerve and have not arrested or cited anyone yet.

I'm relieved that none of those involved in this accident sustained critical or life-threatening injuries. I wish the injured victims the very best for a quick and complete recovery. Please keep them in your prayers.

Car Accident Statistics

There were 16 fatalities and 266 injuries involving car accidents in Victorville in 2008, according to California Highway Patrol's traffic accident statistics. In San Bernardino County as a whole, 263 people died and 8,504 were injured as a result of traffic accidents during the same year.

What Caused this Car Accident?

Based on this news account, officials describe DeGrandis as incoherent after the crash. They have also found marijuana in his vehicle. If it is found that the driver of the Honda was DUI, distracted, or otherwise negligent, he should be held responsible for the accident and the injuries that resulted. In such cases, it is also possible that the car that swerved initially was avoiding an object on the roadway or had moved suddenly because of an unsafe roadway condition. If that is found to be the case, the governmental agency responsible for maintaining the roadway may also be held responsible.

Contacting an Experienced Injury Lawyer

Any car accident investigation involving multiple victims and multiple vehicles can be complex and sometimes even confusing. Each person may have a different account of what occurred. Eyewitnesses who saw the accident from different angles may have their own versions of the story. If you have been injured in such an accident, it is best that you do not discuss the details with any insurance adjusters or other attorneys. Do not provide statements, sign papers, forms or agree to settlements without first talking to your own lawyer. Victims in such cases would be well-advised to seek the counsel of an experienced California personal injury lawyer, who will help protect their legal rights and best interests.
