Temecula Head-on Collision Kills Three, Driver Flees

California Highway Patrol (CHP) investigators are looking for a hit-and-run driver who they say killed a Winchester family of three after crashing head-on into their car near Lake Skinner. According to an article in The Californian, the tragic car accident killed 48-year-old Andres San Augustin, his wife, Maribeth Pagaspas San Augustin and 4-year-old son, Angelo.

Andres San Augustin was northbound on Warren, near the entrance to the Lake Skinner Recreation Area when the truck collision happened. Ron Thatcher, a CHP spokesman said the suspect driver, who was in a 2007 GMC pickup, crossed over the double yellow lines on Warren Road and crashed into the family’s 1991 Chevrolet Malibu. Someone else helped the hit-and-run driver escape from the scene of the accident, officials say. The couple reportedly died on the scene while their son died an hour later in an area hospital.

It is never too late to relay information about auto accidents, especially hit-and-run accidents. California law requires each and every driver to remain at the scene of an accident. Leaving the scene of an accident is illegal whether the accident involves no injuries, injuries and/or fatalities. While it’s illegal, it is also inhumane to walk away from a catastrophic scene where people need help! The hit-and-run driver in this case could face criminal felony manslaughter or murder charges.

The heirs of the deceased accident victims have rights to compensation for the loss of their family members, especially if the deceased couple had other children. Even though this is a hit-and-run case, the family should be consulting a highly skilled personal injury attorney. There are a number of possible “contributing factors” to these deaths that my lead to avenues of recovery besides the hit-and-run driver. The families own auto insurance policy probably has an “uninsured driver” provision that the family can collect from.

Remember that to maintain your rights in any case against a governmental agency, a claim must be properly filed within six months of the accident. Also remember that in order to maintain any claim of a defect in the victims’ automobile that may have contributed to the accident or injuries, the wrecked car must be maintained in its crashed, unrepaired state.
