Man Injured In Vacaville Motorcycle Accident

A 37-year-old man who suffered major injuries in a Vacaville motorcycle accident on November 9, 2008 has been identified as Henry Eaton. The 11/9/08 crash occurred when Eaton was headed north on Peabody Road between Beelard Drive and Marshall Road on his 2007 Harley-Davidson. 79-year-old Alfatoon Edalat, who was driving his 1986 Volvo south on Peabody Road, attempted a U-turn across double yellow lines directly in front of Eaton, causing the collision, Vacaville police officials said. My heart goes out to Henry Eaton who has been severely injured because of another driver’s negligence. Eaton very possibly has a long road to recovery given his severe head injuries. I sincerely hope and pray that he recovers quickly and completely.

Based on this newspaper report, it appears that the elderly driver of the Volvo was at fault for this injury motorcycle crash. California Vehicle Code Section 21801 (a) states: “The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into a public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction, which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to approaching vehicles until the left turn or U-turn can be made with reasonable safety.”

Edalat obviously was anxious to make a U-turn for whatever reason and ended up crossing double yellow lines and driving into the path of Eaton’s Harley-Davidson. Clearly, this was negligence on Edalat’s part. I’d urge Henry Eaton and his family to consult an experienced California motorcycle accident attorney. Eaton would be entitled to compensation to help pay his medical bills, loss of wages, pain and suffering. A skilled personal injury lawyer would also look at other factors that may have played a role in the crash such as a dangerous roadway or intersection. Eaton and his family should preserve the Harley in its crashed state so it can be examined by an expert for mechanical malfunctions or product defects.
