Victorville Motorcycle versus Auto Accident Leaves Two Dead

David M. Orosco, 21, of Hesperia was killed in a Victorville motorcycle accident on November 8, 2008 after a driver turned left in front of him, according to this news report. Orosco was headed south on Hughes Road on a 2003 Honda motorcycle when the driver of a 2007 Chevy Impala turned left on Hughes from Hesperia Road. Carolyn Manson, 56, of Oro Grande, who was a passenger in the Impala also died in the 11/8/08 crash.

Based on this news report, it appears that this fatal Victorville traffic accident was the fault of the driver of the Chevy Impala, who has not been identified. The driver made a left turn when it seems that Orosco had the right-of-way. According to California Vehicle Code Section 21801 (a): “The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety.”

I’d bet the driver of the Impala was not paying attention and simply did not see Orosco approaching the intersection. David Orosco’s family should certainly consult a skilled California motorcycle accident attorney who will fight for their rights and get them the compensation they rightfully deserve. Orosco’s family would have substantial rights to compensation if the driver of the Impala is determined to be at fault.

A skilled personal injury lawyer will also look into whether there was a dangerous condition on the Victorville roadway or intersection that could have been a factor in this accident. If that was the case the city could be held liable. According to California Governmental Code Section 911.2, a personal injury claim against a government agency must be properly filed within six months of the date of injury or death.

    I’m one of David’s cousins and I am just shocked about this whole mess. I didn’t know David as well as my brothers and sisters, but he was a nice guy and didn’t deserve what happened, neither did the driver of the Chevy{who, after reading this article} seemed to be at fault. But you can’t really put the blame on either of the individuals.
