Irvine Man Killed in Orange County Freeway Auto Accident

By

Avishek Dube, 25, of Irvine died in an Orange County auto accident after he was struck on the 405 Freeway. According to this news report in The Orange County Register, Dube’s 1997 Infiniti was disabled in the fast lane because of a prior accident in the early hours of March 7, 2009. Another car that was being driven by Donovan A. Lozada of Fountain Valley and doing about 70 miles per hour then hit the Infiniti, killing Dube. California Highway Patrol officials say Lozada suffered moderate injuries in the crash. The fatal collision occurred on the 405 Freeway just north of Jamboree Road in Irvine.

My heart goes out to everyone who knew and loved Avishek Dube. I offer Dube’s family and friends my deepest sympathies for their untimely loss. Please keep them in your prayers.

The news account of this case leaves many unanswered questions at this point and I trust the CHP investigation will provide more detail in the coming weeks. Was Donovan Lozada driving under the influence of alcohol and/or drugs? Did the road conditions or a lack of lighting on the freeway make it difficult for other drivers to see Dube’s disabled vehicle? Obviously, Lozada did not have sufficient time to stop his car before crashing into Dube’s Infiniti. Was he traveling at a safe speed? Had he been driving a little slower, could he have stopped his vehicle in time to avoid this tragic crash?

The Dube family has suffered a tremendous loss and deserves to know what exactly happened in this fatal car crash. Avishek Dube’s family would be well-advised to contact an experienced Irvine auto accident attorney who will look at all aspects of this case, determine the facts, identify the negligent parties and hold them accountable for their actions.

California Vehicle Code Section 22350 requires that “no person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property. ”
In this Irvine auto accident, Lozada, the driver who hit the stalled car, could be held liable if it is determined that he had been negligent and driving at an unsafe speed for the existing traffic conditions. If investigators determine that Lozada was operating the vehicle under the influence of alcohol or drugs, he could face criminal vehicular manslaughter charges.

We knew Avishek as a family friend, since he was born. He was the nicest person with strong sense of responsibility. It is a great loss to the whole community. He was a very safe driver and, it’s hard to believe that a bright person like him had to end his life on the free-way

I’d like to start out by saying that the Lozada family sends out our prayers and sorrow to the Dube family for their loss. I speak for my brother, his parents, grandparents, aunts, uncles, and cousins when I say that the loss of any human life, especially one so well-thought of, is a tragedy. However, I would be remiss without acknowledging that this blog uses Donovan to insinuate justification for unfounded rage. Donovan was following the rules of the road and had a toxicology screening that ruled out drugs and alcohol. Before thinking about assigning blame, get your facts straight; otherwise, the senselessness of one person’s death is only followed by more senselessness.

I lost touch with Avishek after high school but I know of the one or two times that I did hang out with Avishek he was always happy, and full of life. He was a great person full of only good energy, my prayers go out to his immediate family.
