Based on this newspaper report, it is not clear exactly how or why this pedestrian accident occurred. There are many unanswered questions at this point. Where was Wigfall on Beach Boulevard when he was hit? Was he crossing Beach Boulevard and if he was, was he crossing in a crosswalk or intersection? Did the driver, Jiang, have sufficient time to slow down, stop or avoid hitting Wigfall? Was Jiang under the influence of alcohol or drugs? The answers to these questions will give us a clearer picture of the circumstances of the accident and whether there was any negligence involved on the part of Jiang.
Contacting a California Personal Injury Lawyer
In any car accident that involves major injury or death it is in the best interest of victims (or their families) to consult an experienced Orange County car accident lawyer to get advise about their legal rights and options. It’s important for victims and their families to have a knowledgeable attorney on their side who will fight for their rights and make sure they get compensated fairly for their injuries, damages and loss.
A skilled California personal injury lawyer will also determine whether there was a dangerous condition on the roadway that caused or contributed to this fatal pedestrian accident. If that was the case, the city of Huntington Beach could be held liable as well. Please remember that any claim against a California governmental agency must be properly filed within 180 days of the accident or injury. If Jiang does not have sufficient auto insurance coverage, then Wigfall’s family may be able to seek compensation through the uninsured/underinsured clause of Wigfall’s car insurance policy or any other policy under which he may have benefits.
