Orange County Fatal Pedestrian Accident

By

William Wigfall, 25, died in a Huntington Beach car accident after he was struck by a car on Beach Boulevard. The car accident occurred early morning on July 25, 2009. According to a news report in The Orange County Register, Wigfall was hit by a 2006 BMW sport utility vehicle going north on Beach Boulevard, Huntington Beach police said. The driver of the SUV was 37-year-old Jinmei Jiang of Temple City. Wigfall was transported to a local hospital where he died about two days after the car accident. Charges haven’t been filed pending an investigation. If you witnessed this pedestrian-car accident, please call Huntington Beach police at 714-536-5666.

My heart goes out to the family and friends of William Wigfall. I offer my deepest sympathies to them for their tragic and heartbreaking loss. Please keep them in your prayers.

Orange County Pedestrian Accident Statistics

According to California Highway Patrol’s 2007 Statewide Integrated Traffic Records System (SWITRS), there were two fatalities and 53 injuries involving pedestrian accidents in Huntington Beach. In Orange County as a whole, 41 deaths and 726 injuries were reported as a result of pedestrian accidents in 2007.

Based on this newspaper report, it is not clear exactly how or why this pedestrian accident occurred. There are many unanswered questions at this point. Where was Wigfall on Beach Boulevard when he was hit? Was he crossing Beach Boulevard and if he was, was he crossing in a crosswalk or intersection? Did the driver, Jiang, have sufficient time to slow down, stop or avoid hitting Wigfall? Was Jiang under the influence of alcohol or drugs? The answers to these questions will give us a clearer picture of the circumstances of the accident and whether there was any negligence involved on the part of Jiang.

Contacting a California Personal Injury Lawyer

In any car accident that involves major injury or death it is in the best interest of victims (or their families) to consult an experienced Orange County car accident lawyer to get advise about their legal rights and options. It’s important for victims and their families to have a knowledgeable attorney on their side who will fight for their rights and make sure they get compensated fairly for their injuries, damages and loss.

A skilled California personal injury lawyer will also determine whether there was a dangerous condition on the roadway that caused or contributed to this fatal pedestrian accident. If that was the case, the city of Huntington Beach could be held liable as well. Please remember that any claim against a California governmental agency must be properly filed within 180 days of the accident or injury. If Jiang does not have sufficient auto insurance coverage, then Wigfall’s family may be able to seek compensation through the uninsured/underinsured clause of Wigfall’s car insurance policy or any other policy under which he may have benefits.
