Improperly Secured Load Causes Fatal California Car Accident

By

The California car accident lawyers at Bisnar Chase Personal Injury Attorneys have represented families of victims who have been fatally injured as a result of unsecured loads on our freeways. Recently, there was a report in the Kern Valley Sun of a tragic car accident, which claimed the life of 58-year-old John Paul Hamon of Weldon, California. The fatal car accident occurred July 30, 2009 when 63-year-old Michael Carl Rapport, 63, was traveling on the Highway 178 in Kern County with three 2-by-4 boards tied to the top of his 1990 Ford Bronco. Hamon was traveling west on the highway and Rapport was going east when one of the boards fell off the Bronco, struck and penetrated the windshield of Hamon’s 1995 Ford Explorer directly in front of the driver seat.

Hamon sustained significant head injuries and died instantly, California Highway Patrol officials said. Hamon’s SUV rolled off the road for about 800 feet. Rapport is facing a criminal investigation and could possibly be charged in this fatal crash. Hamon’s passenger, 67-year-old Leta Johnson, was taken to a local hospital with moderate injuries.

Unsecured Load Causes Fatal Injury

My heart goes out to the family and friends of John Paul Hamon for their traffic and heartbreaking loss. I offer my deepest sympathies to everyone who knew and loved Hamon. Please keep them in your prayers.

In my opinion, if officials determine negligence or wrongdoing was involved here, Rapport should be held criminally and civilly liable for causing the fatal accident as well as Johnson’s injuries. This was a horrific car accident, which could have been prevented had Rapport taken some additional time to secure those boards properly. We represented a victim’s family in an identical case. In that case, a mother of two was killed when an aluminum sign flew out of the back of a truck and pierced through the driver’s side of the windshield. We went right after the trucking company and filed a wrongful death claim on behalf of our client and secured $1 million in compensation through their insurance company.

I agree that in any case where a death occurs, the loss is sadly irreparable. No amount of money could bring back our client’s wife. No amount of money could give his children back their mother. Here’s what Rapport had to say about this recent incident: “I feel very bad about the accident, but I feel I did everything right.”

I say if everything had been done right here, then, Hamon would still be alive. Hamon’s family and Johnson, the injured victim, would be well-advised to consult a reputed California personal injury lawyer, experienced in handling these types of freeway debris cases. The best personal injury law firms will offer a free, comprehensive and confidential consultation to injured victims and/or their families.
