Orange County Car Accident Injures Pedestrian

By

A man in his 80s was injured in an Orange County car accident after he was struck by a car while crossing Brookhurst Street in Anaheim, California. According to a news report in The Orange County Register, a black Acura hit the man the night of September 9, 2009 after he was half way across Brookhurst and near Ball Road. There was no crosswalk where the man was walking. He was taken to an area hospital with injuries.

My heart goes out to this injured victim. I hope he did not suffer critical injuries in this Anaheim car accident. I wish him the very best for a quick and complete recovery. Please keep him in your prayers.

Orange County Pedestrian Accident Statistics

According to California Highway Patrol’s 2007 Statewide Integrated Traffic Records System (SWITRS), there were six fatalities and 63 injuries involving pedestrian accidents in Anaheim, California. In Orange County as a whole, 41 deaths and 726 injuries were reported as a result of pedestrian accidents in 2007.

The article states there was no crosswalk where the victim was crossing. That raises the question as to whether there were any other marked crosswalks in the area for pedestrians to get across the road safely. Was the man forced to cross a busy street at that location because there were no crosswalks available to get across? I trust the police investigation will reveal the facts of the case. If I were a family member of the pedestrian, I’d want to know if the accident was caused by someone else’s negligence or recklessness. Was the driver of the Acura going too fast and thus unable to stop? Was the driver intoxicated, distracted or speeding? Was there a dangerous condition on that roadway? The answers to these questions will help determine the cause of this tragic accident and if any negligence was involved.

Orange County Car Accident Liability Issues

In such cases, victims’ families would be well-advised to contact an experienced Orange County personal injury lawyer who will keep up with the investigation and make sure all negligent parties are held liable. If this accident was the fault of the driver and there was wrongdoing involved, he or she could be held civilly and criminally responsible.

A skilled Orange County car accident lawyer could also help determine whether there was a dangerous condition on that roadway, which may have caused or contributed to this car crash. If that was the case, the governmental agency responsible for maintaining that roadway could also be held liable. Please remember that any such claim against a California governmental agency must be properly filed within 180 days of the accident or injury.
