San Bernardino Car Accident Kills Man

By

Robert K. Hamilton Jr., 37, was killed in a San Bernardino car accident the morning of October 25, 2009, The Press Enterprise reports. Hamilton and 32-year-old Rick Batiste were in a Chevy Monte Carlo heading north on Jonathan Street in Adelanto when the vehicle went out of control, flipped and landed on its roof. Batiste managed to get out of the vehicle before it caught fire. However, Hamilton did not make it and died as the fire spread quickly through the inside of the vehicle.

I offer my deepest condolences to the family and friends of Robert Hamilton for their tragic and heartbreaking loss. I’m also relieved that Batiste was able to escape without any injuries. Please keep this victim’s family in your prayers.

San Bernardino Car Accident Statistics

According to California Highway Patrol’s 2007 Statewide Integrated Traffic Records System (SWITRS), three fatalities and 32 injuries were reported in Adelanto, California, as a result of car accidents. In San Bernardino County as a whole, 308 deaths and 9,920 injuries occurred in 2007 involving car accidents.

Based on this news report, it is not clear what exactly caused this car to go out of control, roll over and catch fire. If I were a member of Hamilton’s family, I would certainly want to know whether there was a vehicle defect or a mechanical malfunction in the Chevy Monte Carlo that caused this tragic car accident. The article does not mention that Hamilton was driving recklessly or negligently. Alcohol and fatigue apparently were not factors in this crash either. In any auto product liability case, it is important to preserve the crashed vehicle, unaltered, so it can be carefully examined for product defects, malfunctions and other evidence.

Auto Product Liability Issues

If a product defect is determined to have caused this accident, the auto maker or the manufacturer of the defective product could be held liable for the accident and resulting injuries. In such cases, families of deceased car accident victims may be able to file wrongful death claims against the auto product manufacturer and seek compensation to cover medical/funeral expenses, loss of wages and related damages. A reputable California personal injury lawyer with a stellar track record in auto products liability cases will be able to advise victims and their families about their legal rights and options.
