Long Beach Car Accident Critically Injures Pedestrian

By

A Cal State Long Beach student has sustained critical injuries in a Long Beach car accident after he was struck by vehicle while crossing the road, The Long Beach Press Telegram reports. The pedestrian was in a crosswalk at Seventh Street and West Campus Road when he was struck by a car the night of November 8, 2009. Long Beach police said the female driver initially started to drive away, but then stopped and called for help. The student was taken to an area hospital in critical condition. The driver has not been arrested pending a police investigation.

I hope and pray that this young man who has been critically injured makes it through his injuries and recovers completely. My heart goes out to his family and friends. Please keep this injured victim and his family in your prayers.

Long Beach Pedestrian Accidents

According to California Highway Patrol’s 2007 Statewide Integrated Traffic Records System (SWITRS), there were 15 deaths and 274 injuries involving pedestrian accidents in Long Beach, California. In Los Angeles County as a whole, 210 deaths and 5,095 injuries were reported as a result of pedestrian accidents in 2007. Also, in Los Angeles County, car accidents claimed 712 lives and injured 56,475 people in 2007.

Based on this news report, it seems to me that the driver was at fault for this serious injury accident. The pedestrian was walking in a crosswalk at the time and California law requires motorists to stop and yield right-of-way to pedestrians in crosswalks. California Vehicle Code Section 21950 states: “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection.” The same section also states that the driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk “shall exercise all due care and shall reduce the speed of a vehicle or take any other action relating to the operating of the vehicle as necessary to safeguard the safety of the pedestrian.”

Liability Issues in Car Accidents

I’d be interested to find out why the driver failed to see the pedestrian in the crosswalk? Was she under the influence of alcohol or drugs? Was she distracted at the time? Was she driving too fast or recklessly at the time? Did she break any other traffic laws, such as, running a red light? I trust officials are looking into all these questions as well as other factors, which may have led to this tragic car accident.

The victim and his family would be well-advised to consult with an experienced Long Beach personal injury attorney, who will keep up with the official investigation, analyze the case thoroughly and make sure that the negligent parties are held responsible. A knowledgeable Los Angeles personal injury lawyer will also look into whether a dangerous condition on the roadway caused this accident. In that case, the city or governmental agency in charge of maintaining the roadway could be held liable as well. In such cases, victims could seek compensation from the at-fault parties to cover medical expenses, loss of wages, cost of hospitalization, rehabilitation and other related damages. The best personal injury law firms will provide a free and comprehensive initial consultation to injured victims and their families. Please remember that any claim against a California governmental entity must be filed within 180 days of the accident or injury.
