Jessica Ann Faber, 18, a Huntington Beach resident was killed in a car accident on the Interstate 80 near Truckee, California, after her vehicle was struck by a wrong-way driver. According to a news report in The Union, Faber and 23-year-old passenger, Gregory Wessels, were on their way to a property in Truckee owned by Faber’s family. California Highway Patrol officials said Faber was driving east on the Interstate 80 the morning of December 29, 2009, when a vehicle being driven the wrong way by 21-year-old Christopher Dann struck Faber’s car head-on. Faber’s vehicle caught fire. She died at the scene as did Dann. Wessels sustained major injuries and burns and remains hospitalized in serious condition.
Tragic Car Accident
I offer my deepest condolences to the family and friends of Jessica Ann Faber for their tragic and heartbreaking loss. My heart also goes out to Gregory Wessels who is apparently fighting for his life. I hope and pray that he makes it through these injuries and recovers completely. Faber’s family and the injured Wessels will be in my prayers.
Liability and Compensation
Based on this news report, it is not clear how Dann got on to the wrong side of the Interstate 80. But given the fact that this fatal accident occurred in the early morning hours, it is possible that Dann was driving under the influence. In this case, Dann also died in the crash. Still, the injured party or family of the deceased victim can file a wrongful death lawsuit against Dann’s estate or a personal injury claim with his insurance company. If Dann was uninsured or underinsured, Wessels or Faber’s family may be able to claim compensation through the uninsured/underinsured motorist clause of their own car insurance policy.
I can imagine the heartache and expenses Wessels’ family is faced with right now. It would be in their best interest to get in touch with an Orange County personal injury lawyer, who can guide them through what can be a complex legal process and help them secure compensation to cover medical expenses, loss of earnings, cost of hospitalization, rehabilitation, therapy, surgeries and other expenses.
