San Bernardino Car Accident Fatally Injures Bicyclist

By

A 47-year-old man has been fatally injured in a San Bernardino car accident, after his bicycle was struck by an SUV the evening of December 16, 2009. According to a news report in the San Bernardino Sun, the man, whose identity has not yet been released was riding across Bloomington Avenue near Vine Street in Bloomington, when he was hit by a 2003 Chevrolet Suburban that was traveling east. An investigation is ongoing.

I offer my deepest condolences to the family and friends of this deceased victim for their devastating loss. Please keep them in your prayers.

San Bernardino Accident Statistics

According to California Highway Patrol’s 2007 Statewide Integrated Traffic Records System (SWITRS), there were 28 fatalities and 627 injuries involving bicycle accidents in San Bernardino County. Also, countywide, 308 deaths and 9,920 injuries were reported as a result of car accidents.

Car Accident Causes and Liability Issues

This news report does not offer much information about exactly, how or why the Chevy Suburban hit the bicyclist. There are many questions here. Where exactly was the 47-year-old bicyclist at the time of the collision? If this fatal car accident occurred at an intersection, it is important to find out who had the right-of-way? Was the driver of the Suburban under the influence? Was he or she distracted? Was he or she reckless, speeding or otherwise negligent at the time? Who was at fault here?

If the driver of the Suburban caused this car collision, he or she could be held liable for the accident and the fatality. If a dangerous roadway condition caused or contributed to the crash, then the city or governmental agency responsible for maintaining this roadway could also be held liable. Any claim against a governmental agency must be filed within 180 days of the accident or injury, according to California Government Code.

In such cases, the victims’ family would be well-advised to consult with an experienced San Bernardino car accident lawyer, who will analyze all aspects of the accident and make sure the negligent parties are held accountable for their actions.
