James Harris, 60, was killed in a San Bernardino car accident after his vehicle was involved in a head-on collision with another car. According to a news report in the San Bernardino Sun, the crash occurred the evening of December 26, 2009 on Highway 18, near Colorado Road, as Harris was heading east in a 2008 Pontiac G6. A westbound driver on the highway, while attempting to pass another westbound vehicle, crossed over into opposing traffic lanes and crashed head-on into Harris’ car. Harris was transported to an area hospital where he died. California Highway Patrol officials are investigating this fatal car accident.
I offer my deepest condolences to the family and friends of James Harris for their tragic and heartbreaking loss. My heart goes out to everyone who knew and loved this man. Please keep this grieving family in your prayers.
Car Accident Statistics
There were 126 fatalities and 2,255 injuries involving car accidents in the unincorporated areas of San Bernardino County in 2007, according to CHP’s traffic accident statistics. In San Bernardino County as a whole, 308 deaths and 9,920 injuries were reported as a result of car accidents during the same year.
Who Caused this Deadly Accident?
If the details in this news report are accurate, it appears that the driver of the other vehicle, who crossed into the opposing traffic lanes, was at fault for the head-on collision. There is no word yet on whether CHP officials are charging this driver with reckless driving or vehicular manslaughter. Irrespective of the criminal charges that may be filed in this case, if this driver is found to be at-fault for the fatal car accident, he could be held civilly liable for the death of James Harris.
Wrongful Death Claims
Where negligence or wrongdoing is involved, families of deceased car accident victims can file, what is known as, a wrongful death claim against the negligent party. Such a claim seeks compensation to cover medical/funeral expenses, loss of future earnings, loss of love and companionship and other related damages. An experienced San Bernardino car accident lawyer will be able to advise the victim’s family about their legal rights and options. A knowledgeable car accident lawyer will also stay on top of the official investigation and make sure the family’s legal rights and best interests are protected.
