Two people were killed in a Los Angeles car accident after two vehicles collided on a Pomona street, the Inland Valley Daily Bulletin reports. Police officials say a 2005 Nissan Frontier pickup truck exited the westbound 10 Freeway the night of January 14, 2010. The pickup truck then ran a red light and struck a 2006 BMW 325i heading north on Towne Avenue. Both cars overturned and one of them was fully engulfed in flames. Both drivers died at the scene.
My heart goes out to the families of the deceased victims in this case. I offer my deepest condolences to them. These grieving families will certainly be in my prayers.
There were 11 fatalities and 894 injuries involving car accidents in Pomona in 2007, according to California Highway Patrol’s traffic accident statistics. In Los Angeles County as a whole, 712 deaths and 56,475 injuries were reported as a result of car accidents in 2007.
What Caused this Fatal Accident?
Based on this news report, it’s not clear what caused the driver of the Nissan Frontier to run the red light and hit the BMW. Was he or she under the influence? Was the driver operating the vehicle recklessly, speeding or trying to beat the light? Was there a vehicle defect or a mechanical malfunction in the Frontier, which caused the driver to lose control and crash?
Car Accident Laws and Liability Issues
Running a red light is a serious traffic violation under California law. There are various California Vehicle Code sections that are part of what we commonly refer to as “rules of the road.” These code sections address motorists’ behavior at intersections, especially those controlled by traffic signals. California Vehicle Code Section 21453 (a) states: “A driver facing a circular red signal shall stop at the limit line before entering the crosswalk on the near side of the intersection or, if none, then before entering the intersection, and shall remain stopped until an indication to proceed is shown.”
The families of deceased victims in such cases would be well-advised to contact an experienced Los Angeles personal injury lawyer, who will analyze all aspects of the crash and make sure the negligent parties are held accountable. In this case, if the driver of the Nissan was found to be at fault, the family members of the deceased BMW driver can file a wrongful death claim against the other driver’s estate and his insurance company. An experienced car accident lawyer should also advise victims or their families how their own car insurance policy applies to an accident or an incident involving an uninsured or underinsured motorist.
