A man who was killed in a San Bernardino car accident the evening of December 26, 2009 has been identified as James Harris, 60, of Pinon Hills. The San Bernardino Sun reports that Harris was involved in a head-on collision with another car, as he was heading east on Highway 18 near Colorado Road, in his 2008 Pontiac G6. San Bernardino Sheriff’s officials say a driver who was going west struck Harris’ car while attempting to pass another vehicle. Harris was taken to an area hospital where he was pronounced dead. The incident is being investigated by California Highway Patrol officials.
My heart goes out to everybody who knew and loved James Harris. I offer my deepest sympathies to his family members and friends for whom this must have been a devastating loss. This family will be in my prayers.
According to CHP’s 2007 Statewide Integrated Traffic Records System (SWITRS), 126 deaths and 2,255 injuries were reported as a result of car accidents in the unincorporated areas of San Bernardino County. Countywide, car accidents claimed 308 lives and caused 9,920 injuries during the same year.
Accident Causes and Liability Issues
Based on this newspaper report, it seems to me that the driver of the other vehicle was driving recklessly. He attempted to pass another vehicle, crossed into opposing lanes of traffic and crashed into Harris’ Pontiac head-on. We don’t know yet whether this driver is facing any criminal charges. We also do not know whether he was impaired or distracted at the time of the collision. Whatever the cause, if he is determined to be at-fault here, then, he should be held liable for the accident and fatal injuries caused.
Harris’ family would be well-advised to contact an experienced San Bernardino car accident attorney who will stay on top of the official investigation and make sure they receive fair compensation in this case. Harris’ family may be able to file a wrongful death claim against the at-fault party seeking compensation for medical/funeral expenses, loss of earnings and other damages related to this accident.
