Luis Sarabia Trujillo, 23, was identified as the driver who was killed in a car accident which officials say was caused by distraction. The crash also killed one of his passengers, 20-year-old Omar Gaytan. According to a news report in The Daily Democrat, the accident occurred on February 4, 2010. David Pearl, 53, was driving his 2002 Ford Ranger pickup north on County Road 89 near CR-26 when he became distracted with the CD player in his truck.
California Highway Patrol officials said Pearl’s truck drifted off the right shoulder causing him to overcorrect and sending him into the path of a 1997 Grand Am, driven by Trujillo and traveling in the southbound lane. The result was a head-on collision. Trujillo sustained major head injuries and died at the scene. Pearl sustained minor injuries. Edward Blanco, 30, and Francisco Gonzalez, 24, both passengers in Trujillo’s car, were taken to the hospital with injuries.
I offer my deepest condolences to the family and friends of Luis Trujillo and Omar Gaytan for their tragic and heartbreaking loss. Please keep them in your prayers. I also wish Blanco and Gonzalez the very best for a speedy and complete recovery. I hope they have not sustained any catastrophic injuries in this crash.
Based on this news report, it appears that David Pearl, the driver of the pickup truck, was at fault here because he took his eyes off the road while operating his CD player. CHP have ruled this incident as an “accident.” However the case has been forwarded to the district attorney for review. Even the CHP official interviewed by the newspaper says that it is unlikely that Pearl will face manslaughter charges. Even if he does, it is unlikely that the case will proceed all the way to conviction.
Although Pearl may not face criminal charges in this case, he could still be held liable for Trujillo’s and Gaytan’s deaths and the injuries caused to Blanco and Gonzalez. He could be held financially responsible in this case. The injured victims could seek compensation to cover medical expenses, lost earnings, cost of hospitalization, physical therapy and other related damages.
