By

A man sustained critical injuries in a Los Angeles car accident after a truck rear-ended his vehicle on March 19, 2010, triggering a chain-reaction crash involving several other vehicles. The San Gabriel Valley Tribune reports that the injury collision, which involved nine vehicles, occurred when a big-rig apparently lost its brakes near the intersection of Mar Vista Street and Colima Road, and crashed into the Toyota Tacoma pickup truck driven by the victim. Two others sustained minor injuries. The injured victim is still in critical condition. An investigation is ongoing. My heart goes out to this seriously injured victim and his family for what they are going through at this point. I hope and pray that he recovers quickly and completely from his injuries.

Car Accident Statistics

There was one fatality and 358 injuries involving car accidents in Whittier in 2008, according to California Highway Patrol’s traffic accident statistics. In Los Angeles County as a whole, 667 deaths and 52,229 injuries were reported as a result of car accidents during the same year.

Fault and Liability Issues

Based on this news report, it appears that this truck accident was caused by the big-rig’s driver who initially rear-ended the victim’s Toyota. That in turn caused a chain-reaction crash. Officials say the truck may have lost its brakes. In this case, if I were a member of the injured victim’s family, I would want to find out exactly what happened. Was the driver of the big-rig fatigued or distracted? Was he driving at an unsafe rate of speed given the traffic conditions? Was the truck poorly maintained? Was the truck driver under the influence of alcohol or drugs? I trust officials are investigating these and other issues in order to determine precisely what happened here.

If this accident is determined to have been the truck driver’s fault, then, the truck driver, as well as his employer, could be held liable for the accident and injuries caused. It is the responsibility of a driver and the company that owns the truck to make sure that the vehicle is in proper working condition before it gets on the road. Victims in such cases could seek compensation to cover medical expenses, lost earnings, cost of hospitalization, rehabilitation, pain and suffering, and other related damages.

I’m a friend of the daughter of the injured man. I was talking to her tonight and she told me that the company which owns the truck is “a tiny bankrupt establishment.” Does this pretty much leave her family without any options? I’ve been looking around online at articles about the accident and have found a lot of comments from local residents claiming that this intersection has severe design problems which have gone ignored for years, so I didn’t know if they could also look to the city for compensation?

Just because a company is small or may be bankrupt doesn’t mean that it doesn’t have a liability insurance policy that will cover the damages it has caused. Many small companies are owned by larger, healthier companies or individuals who may have more than enough insurance or assets to pay the damages they have caused. If in fact the intersection has severe design problems or is dangerous for other reasons, the city, county or state may have some liability for the injuries. The injured man’s family would be smart and well within their rights to consult with a personal injury firm that handles catastrophic injury traffic accidents, insurance claims cases and dangerous roadway condition cases against governmental agencies (yes, in case you are wondering, we have a long and successful history of handling all three types of cases). Keep in mind that any claim against a governmental agency needs to be properly made within 180 days of the accidents to avoid the loss of all rights. Also keep in mind that the best law firms that handle these type of cases will provide a free, no obligation, confidential consultation to the injured person and their family.
