Two people were injured in a Fresno car accident the morning of April 2, 2010 after a vehicle made an unsafe maneuver on Highway 168, triggering a head-on collision. According to a KMPH news report, one of the vehicles went into the opposing lane while attempting a turn. California Highway Patrol officials say the female driver of a “Smart Car” was transported to a local hospital. She sustained major injuries. The other driver apparently suffered minor injuries. It is not clear which one of the drivers made the unsafe movement.
My heart goes out to the seriously injured victim in this car crash. I hope and pray that she has a quick and complete recovery from her injuries. This accident is yet another reminder for all motorists to drive cautiously, especially in mountainous terrain or winding roads.
Fresno Car Accident Statistics
According to CHP’s 2008 traffic accident statistics, 33 fatalities and 1,485 injuries were reported as a result of car accidents in Fresno. Countywide, 127 people died and 3,323 were injured due to car accidents during the same year.
Fault and Liability Issues
Based on this news report, it is not clear which one of the two drivers caused this accident. If the driver of the Smart Car caused this accident, she could be held liable. However, if the other driver was the one who made the unsafe maneuver, he or she could be held liable for the accident and serious injuries caused to the driver of the Smart Car. In such cases, victims can seek compensation to cover medical expenses, lost wages, cost of hospitalization, rehabilitation, physical therapy and other related damages.
If this accident was caused by a dangerous or defective roadway, the governmental entity responsible for maintaining the roadway could be held liable as well. Please remember that under California Government Code 911.2, any such claim must be filed within 180 days of the accident or injury.
Victims in such cases would be well-advised to consult an experienced Fresno personal injury lawyer, who will stay on top of the official investigation and make sure that the negligent parties are held accountable for their actions. It is best for victims not to talk to insurance adjusters or attorneys for the other parties prior to getting a knowledgeable injury lawyer on their side, who will protect their legal rights and interests.
