By

A bicyclist was killed in a Los Angeles car accident after he was struck by a suspected drunk driver who also left the scene of the accident. According to a CBS news report, police arrested William Keith Square, 40, on suspicion of felony DUI, vehicular manslaughter and hit-and-run. Los Angeles Sheriff’s Department officials say the fatal bicycle accident occurred the night of April 17, 2010, at the intersection of Santa Fe Avenue and East 218th Place. Square was traveling north on Santa Fe in an SUV when he struck the bicyclist. The victim was transported to a local hospital where he died.

Bicycle Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), in Carson, there were no fatalities, but 16 injuries involving bicycle accidents. In Los Angeles County as a whole, 33 fatalities and 3,315 injuries were reported as a result of bicycle accidents during the same year.

California Laws

If the details of this news report are accurate, it appears that the driver of the SUV, William Keith Square, not only drove his vehicle under the influence of alcohol, but also left the scene of the crash. Driving under the influence is a serious crime in California. According to California Vehicle Code Section 23152 (a): “It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle.”

Leaving the scene of an accident or hit-and-run is also a serious violation of the law. According to California Vehicle Code section 20001: “The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident.”

Protecting Your Rights

In such cases, victims and their families would be well-advised to retain the services of an experienced Los Angeles personal injury lawyer, who will stay on top of the criminal investigation and make sure that their legal rights are protected. A skilled car accident lawyer should also advise victims about how their own car insurance policy applies to a hit-and-run accident or in a case where the at-fault driver is uninsured or underinsured.
