Los Angeles DUI Collision Kills Pedestrian

By

A pedestrian was killed in a Los Angeles car accident after a suspected drunk driver struck a traffic light, which then fell on top of the victim. According to a KTLA News report, the fatal accident occurred early morning on April 12, 2010 near the intersection of Western Avenue and Pico Boulevard. Los Angeles police officials say 27-year-old Jasen Jack was driving a 2008 Dodge Caliber southbound on Western Avenue when his vehicle left the roadway and hit the traffic signal. The impact of the collision pushed the signal on top of the pedestrian, who was standing on the northwest corner of the intersection. The victim died at the scene. Police arrested Jack on suspicion of driving under the influence.

DUI Collisions in Los Angeles

According to California Highway Patrol’s 2008 traffic accident statistics, there were 105 fatalities and 2,252 injuries involving DUI collisions in Los Angeles. Countywide, alcohol-related crashes claimed 258 lives and caused 4,832 injuries during the same year.

Drunk Driving Laws

Based on this news report, it appears that the driver of the Dodge, Jasen Jack, was driving his vehicle under the influence of alcohol or drugs. Operating a motor vehicle under the influence of alcohol or drugs – recreational or prescription is against California law. Under California Vehicle Code section 23152 (a): “It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle.” A driver whose act of driving under the influence results in the death of another will likely face vehicular manslaughter charges under California Penal Code section 191.5 (a).

Liability Issues

Families of victims in such cases would be well advised to contact an experienced Los Angeles personal injury attorney, who will stay on top of the official investigation and ensure that the victims’ rights and best interests are protected. If Jack is found guilty of driving under the influence, he should be held criminally and civilly liable in this case. A knowledgeable car accident lawyer can also advise victims and their families about how their own car insurance policy will apply to an accident case where the at-fault or negligent motorist is uninsured or underinsured.
