San Diego Car Accident Results in Two Fatalities

By

Michelle Santos, 32, was one of two people who sustained fatal injuries in an Escondido car accident the morning of April 18, 2010. According to a San Diego 6 news report, Santos was westbound on Old Castle Road near Champagne Boulevard when her vehicle entered opposing lanes of traffic and slammed head-on into another vehicle. Santos as well as the 65-year-old Fallbrook woman in the other car, were killed in the crash. The coroner is yet to release the name of the other victim.

My heart goes out to everyone who knew and loved these two victims. I offer my deepest sympathies to their families and friends. They will be in my prayers.

Car Accident Statistics

Countywide in San Diego, there were 246 deaths and 13,527 injuries involving car accidents in 2008, according to California Highway Patrol’s Statewide Integrated Traffic Records System (SWITRS). In Escondido 10 fatalities and 732 injuries were reported in 2008 as a result of car accidents.

Causes and Liability Issues

It is not clear based on this news report why Michelle Santos lost control of her vehicle and caused this fatal head-on collision. Did she fall asleep at the wheel? Was she under the influence of alcohol or drugs? Was there a dangerous condition on the roadway? Did she get cut off by another vehicle? Or was she simply distracted or inattentive? Was there an auto product defect or a mechanical malfunction in Santos’ vehicle that led to this crash?

If Santos’ family members suspect a vehicle malfunction, it is important that they preserve the vehicle, intact, so it can be carefully examined by an expert for product defects, malfunctions and other evidence. If this accident is determined to have been caused by a vehicle defect, the auto maker or the manufacturer of the defective product can be held liable. On the other hand, if Santos is determined to have been at fault, the family of the other deceased victim can file a wrongful death claim against Santos’ estate and her insurance. In such cases, an experienced Escondido car accident lawyer will be of invaluable assistance, and can help guide victims and their families through, what can prove to be, complex legal issues.
