San Diego Car Accident Kills Two

By

Rebecca Evene O’Mara, 21, and Joshua Creston Carr, 25, were killed in a San Diego car accident on the Interstate 8 in Mission Bay Park. According to a 10news report, the fatal head-on collision occurred the morning of May 1, 2010 on the Ocean Beach Freeway near the intersection of Sunset Cliffs Boulevard. O’Mara and Carr, who were in a 2008 Honda Civic Coupe, were killed in the crash. Adrian Villaneuva Jr, 25, who was the driver of the other vehicle, a Toyota Tundra, sustained a broken right wrist and collarbone, California Highway Patrol officials said. He was transported to a local hospital for treatment of his injuries. Officials are in the process of determining whether Villaneuva was driving under the influence and also which driver was going the wrong way at the time.

San Diego Car Accidents

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), there were 81 fatalities and 6,123 injuries involving car accidents in San Diego. During the same year, countywide, car accidents claimed 246 lives and injured 13,527 people.

Who Was the Wrong-Way Driver?

Based on this news report, it is still not clear who caused this fatal head-on crash. It is also not clear if officials had reason to believe that Villaneuva was under the influence at the time. If it is determined that Villaneuva was at fault, he could be looking at serious criminal charges including vehicular manslaughter. If he was at fault, Villaneuva could also be held civilly liable for the wrongful deaths of O’Mara and Carr. On the other hand, if the driver of the Civic turns out to have been the wrong-way driver, the injured Villaneuva could file a personal injury claim against that driver’s estate or liability insurance.
