Orange County Car Accident Injures Five

By

Five people, including two children, were injured in a Laguna Niguel car accident when another vehicle turned left in front of a Mazda 626 at a local intersection. The Orange County Register reports that the injury collision occurred the afternoon of June 17, 2010 at the intersection of Street of the Golden Lantern and Marina Hills Drive. Officials say the driver of an Infiniti was headed north on Golden Lantern and turned left in front of the Mazda at Marina Hills. Four of those injured were transported to a nearby hospital. One victim was taken to an area trauma center. An investigation is ongoing.

My heart goes out to the injured victims of this car accident. I hope no one has sustained catastrophic injuries in this crash and pray for their speedy and complete recovery. They will be in my thoughts and prayers.

Car Accidents

According to California Highway Patrol’s 2008 Statewide Integral Traffic Records System (SWITRS), there were two fatalities and 107 injuries involving car accidents in Laguna Niguel. In Orange County as a whole, 153 people died and 13,414 were injured as a result of car accidents during the same year.

Yielding Right-of-Way

Based on this news report, it appears that the driver of the Infiniti may have failed to yield right-of-way to the Mazda. California Vehicle Code Section 21801 (a) states: “The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety.”

Fault and Liability

There are many issues that warrant investigation in this particular case. Who had the light at the intersection at the time of the collision? Who had the right-of-way? Was the driver of the Infiniti impaired, distracted or otherwise negligent at the time of the collision? If the driver of the Infiniti is determined to have been at fault, then he or she could be held liable for the accident and resulting injuries.
