Car Crash Results in Major Injuries for San Bernardino Pedestrian

By

A man who was severely injured in a pedestrian accident in San Bernardino has been identified as 21-year-old Christopher Neal. The San Bernardino County Sun reports that the major injury collision occurred the night of July 22, 2010 on State Route 62 in Twentynine Palms. Authorities said Neal was walking in the eastbound lanes of the roadway when he was struck by a vehicle going in the same direction, which was driven by 46-year-old Lori McNay. Officials are investigating the cause of the crash. Neal was transported to a nearby medical center for treatment of major injuries.

I hope Neal has not sustained catastrophic injuries as a result of this collision. I wish him the very best for a quick and full recovery from his injuries.

Car Accident Statistics

Two fatalities and 41 injuries were reported due to car accidents in Twentynine Palms in 2008, according to California Highway Patrol’s Statewide Integrated Traffic Records System (SWITRS). During the same year, 263 people died and 8,504 were injured as a result of car accidents in San Bernardino County.

Dangerous Roadway?

This newspaper report does not clearly state how or why this major injury crash occurred. The news report states that the driver, McNay, did not see the pedestrian until it was too late. Also, there were no street lights in the area where the collision occurred, according to officials. Did this crash occur as a result of a dangerous roadway condition? I trust officials are also looking into whether the motorist or the pedestrian were at fault in this case. If the driver is determined to have been at fault, she could be held financially liable for the victim’s medical expenses, loss of wages, cost of hospitalization, rehabilitation and other expenses.

If a dangerous condition on the roadway caused the injuries, the public entity that maintains the roadway could be held liable. Please remember, any such personal injury claim against a California governmental entity must be filed within six months of the incident.
