Fatal Car Crash in Fresno

A driver running a stop sign at an intersection may have led to a fatal car accident in Fresno that killed two people the morning of July 16, 2010, CBS News reports. The fatal crash occurred at the intersection of American Avenue and Temperance when the driver of a Buick ran a stop sign and struck the Jeep. The driver of the Jeep as well as a woman, who was a passenger in Buick, died as a result. Officials are investigating the incident.

My heartfelt sympathies go out to everybody who knew and loved the deceased accident victims. They will certainly be in my prayers.

Car Accidents

Countywide, 127 people died and 3,233 were injured in 2008 as a result of car accidents, according to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS). In the city of Fresno, 33 fatalities and 1,485 injuries were reported as a result of car accidents during the same year.

According to California Vehicle Code section 21802 (a): “The driver of any vehicle approaching a stop sign at the entrance to, or within, an intersection shall stop as required by Section 22450. The driver shall then yield the right-of-way to any vehicles which have approached from another highway, or which are approaching so closely as to constitute an immediate hazard, and shall continue to yield the right-of-way to those vehicles until he or she can proceed with reasonable safety.”

If I were a member of the deceased victims’ family, I would want to know why the driver of the Buick ran the stop sign. Was the driver impaired, distracted, speeding or otherwise negligent at the time? Was there a dangerous or defective condition on the roadway? If the driver of the Buick is determined to have been at fault, he could not only face criminal charges, but can also be held financially responsible for the accident and injuries caused.

If a dangerous condition on the roadway caused the accident, then the city or governmental agency responsible for maintaining the roadway could also be held liable.
