DUI Collision Proves Fatal for Motorcyclist

By

Officials are saying that a DUI collision may have triggered a series of crashes, which resulted in the death of a motorcyclist and injured 10 others on August 3, 2010. According to KCRA news report, the fatal crash occurred on the Interstate 505, near Putah Creek Road, in Winters.

California Highway Patrol officials say the sequence of events began when a car spun out and crashed into a guardrail on the freeway. Then, two other vehicles collided with that car. The motorcyclist attempted to avoid the crash but he ended up crashing into the freeway divider. He died at the scene. The 10 others injured in this crash suffered minor to moderate injuries. The driver of the car that initially collided with the guardrail is suspected of driving under the influence.

My heart goes out to the family and friends of the motorcycle rider who lost his life. My thoughts and prayers are also with everyone who suffered injuries in this sudden and tragic car accident.

Accident Statistics

According to CHP’s 2008 Statewide Integrated Traffic Records System (SWITRS), there were no fatalities, but seven injuries reported as a result of car accidents in Winters. In Yolo County as a whole, 24 people died and 767 sustained personal injuries due to car accidents during the same year.

DUI Laws and Liability Issues

It is against California law to drive under the influence of drugs and/or alcohol. According to California Vehicle Code Section 23152 (a): “It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle.” A driver whose act of driving under the influence results in the death of another will likely face vehicular manslaughter charges under California Penal Code section 191.5 (a).

Injured victims of DUI collisions may file a claim seeking compensation to cover medical expenses, lost wages, cost of hospitalization, rehabilitation and other related damages. Families of deceased victims could file a wrongful death claim seeking compensation for medical expenses, funeral costs, lost future earnings, loss of love and companionship, and other related damages. An experienced California personal injury lawyer will be able to advise victims about their legal rights and options in such cases.
