A 78-year-old woman sustained critical injuries in a Huntington Beach car accident the morning of August 26, 2010, The Orange County Register report. My thoughts and prayers are with the woman injured in this pedestrian accident. I wish her a full and complete recovery from her critical injuries.

Pedestrian Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), there were five fatalities and 59 injuries in Huntington Beach as a result of pedestrian accidents. That same year, 31 people were killed and 785 people were injured in Orange County pedestrian accidents.

California Crosswalk Law

California law requires drivers to yield to pedestrians legally crossing the street in crosswalks and at intersections. California Vehicle Code Section 21950 states: “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection.” The same section also states that the driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk “shall exercise all due care and shall reduce the speed of a vehicle or take any other action relating to the operating of the vehicle as necessary to safeguard the safety of the pedestrian.”

Liability Issues

If the elderly driver in this case is determined to have been at fault, then, he could be held liable for the woman’s serious injuries. In such cases, injured victims could seek compensation to cover medical expenses, loss of earnings, cost of hospitalization, rehabilitation and other related damages. I trust officials are also looking into whether this motorist was disoriented, distracted or otherwise negligent at the time. Many of the commenters to this Register article believe that the age of the driver may have played a role in this accident. Do you believe there should be additional driving tests for elderly motorists?
