Oakland Car Accident Injures Pedestrian

By

A hit-and-run collision in Oakland critically injured a male pedestrian the night of August 29, 2010. Bay City News reports that the pedestrian accident occurred at a Highway 980 off-ramp. Officials have determined that the man’s injuries were consistent with that of a hit-and-run collision. Although he sustained severe head injuries and fractures, the pedestrian is expected to survive. Police are looking for the suspect, but no vehicle or suspect description is available.

I truly hope the victim in this case did not suffer catastrophic injuries. I trust the suspect in this case will promptly be apprehended and brought to justice. Hit-and-Run Statistics

According to the California Highway Patrol’s traffic accident statistics, there were 17,158 hit-and-run collisions that resulted in fatalities or injuries in California in 2008. A majority of these car accidents involved injuries. There were a total of 247 deaths in 2008 involving hit-and-run collisions statewide.

Laws and Liability

California Vehicle Code Section 20001 (a) prohibits drivers from leaving the scene of an accident. In this case, it is also likely that the driver failed to yield right-of-way to the pedestrian. California Vehicle Code section 21950 states: “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection.” The same section also states that the driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk “shall exercise all due care and shall reduce the speed of a vehicle or take any other action relating to the operating of the vehicle as necessary to safeguard the safety of the pedestrian.”

In such cases where negligence or wrongdoing may be apparent, an experienced Oakland personal injury lawyer will be able to advise victims about their legal rights and options.
