Paris Hilton and her boyfriend CY Waits were in a Hollywood car accident Wednesday night when they ran into a photographer. They had dinner at Boa Steakhouse in West Hollywood, but the night turned south after they reportedly ran over a paparazzi’s foot. An ambulance was called to the scene and medics tended to the injured female photographer, who was later transported to hospital for treatment.
In most car versus pedestrian accidents, it is the driver who is at fault. However, if a pedestrian negligently steps into the path of a moving motor vehicle, clearly the pedestrian is liable for his or her own injuries.
Although the initial news reports do not shed much light on the “facts” of the accident to be able to give an accurate assessment of who may be at fault, I can imagine how aggressive paparazzi are in attempting to get photos of Paris Hilton and CY Waits that they would take unreasonable chances to get one of their precious photographs of the couple. It will be interesting to see how this turns out.
If the injured paparazzi came to us for a consultation, I would quiz them heavily on every detail of what happened. Unless the injury was serious, the paparazzi acted completely reasonably, and there was negligence on the part of the driver to the vehicle Paris Hilton and CY Waits were in, we would not represent the paparazzi.
There are plenty of attorneys who would, however, if not just for the publicity.
