San Bernardino Hit-and-Run Collision Proves Fatal

By

Daniel Lugo, 80, was killed in a San Bernardino car accident after he was struck by a vehicle while walking on Outer Highway 18 near Tao Road in Apple Valley. According to a news report in The San Bernardino County Sun, the fatal pedestrian accident occurred the night of September 18, 2010.

What happened to Lugo is outrageous. The driver apparently left the scene of the accident after causing what led to an innocent man’s death. It is never okay to flee the scene of an accident. Officials are looking for the hit-and-run suspect. No vehicle or suspect descriptions are available at this time. If you saw this accident or have any information, please contact authorities or please visit our web site, www.hitandrunreward.com, to find out how you can leave an anonymous tip and become eligible for a $1,000 reward.

I offer my deepest condolences to the family and friends of Daniel Lugo for their tragic and devastating loss. Please keep them in your thoughts and prayers.

Pedestrian Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), two people were killed and seven were injured in Apple Valley pedestrian accidents. During the same year, 39 fatalities and 432 injuries were reported as a result of pedestrian accidents in San Bernardino County.

Leaving the Scene of a Crash

It is unclear from this news account what may have caused this fatal pedestrian accident. What we do know is that the driver illegally left the scene of the accident. California Vehicle Code Section 20001 (a) states: “The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident.” I trust the driver in this case will soon be apprehended and brought to justice.

Liability Issues

Hit-and-run accidents pose unique challenges for victims and their families. When the at-fault party is not found, it may be difficult for the victim’s family to receive compensation for their losses. An experienced San Bernardino personal injury lawyer will be able to better advise victims’ families about how they may be able to pursue compensation through the uninsured/underinsured motorist clause of their auto insurance policy.

If the driver in this particular case is apprehended, he or she could face criminal charges and be held civilly liable for Lugo’s wrongful death. Families of deceased car accident victims may file wrongful death claims against at-fault motorists seeking compensation for funeral expenses, lost future income, loss of love and companionship, and other related damages.
