Authorities have identified a 49-year-old man killed in a motorcycle accident in Los Angeles as Fred Fraijo. The San Gabriel Valley Tribune reports that Fraijo’s motorcycle crashed into a big-rig on the eastbound 10 Freeway in Covina the morning of September 22, 2010. The impact from the collision caused the motorcycle to ignite. Fraijo was pronounced dead at the scene of the crash. An investigation is ongoing.
My heart goes out to everyone who knew and loved Fred Fraijo for their tragic and devastating loss. Apparently he was a beloved softball coach at a local high school. His loved ones will be in my prayers.
There were 114 fatalities and 2,934 injuries reported as a result of motorcycle accidents in Los Angeles County, according to CHP’s 2008 Statewide Integrated Traffic Records System (SWITRS). According to the Federal Motor Carrier Safety Administration (FMCSA), there were 304 fatalities and 3,196 injuries involving truck accidents in California, in 2008.
Fault and Liability
Based on this news report, it is not clear who was at fault for this deadly accident. Was speed or alcohol involved? Was the truck driver distracted or negligent at the time? Were unsafe lane changes involved? Was there a dangerous condition on the roadway, which may have caused or contributed to this collision? Were any auto product defects or malfunctions factors in this crash? I trust officials are examining these and other issues in order to determine precisely what occurred here.
If this accident was the truck driver’s fault, then, the driver as well as his or her employer could be held liable for Fraijo’s wrongful death.
