A man was injured in a Los Angeles car accident after his bicycle was struck by a minivan the afternoon of October 10, 2010. According to a news report in The San Gabriel Valle Tribune, the injury car accident occurred at the intersection of El Monte Avenue and Las Tunas Drive in Arcadia. The bicyclist is in critical condition following the accident and authorities are still investigating the cause of the car accident.
My thoughts and prayers are with the injured bicyclist. I wish him a complete and speedy recovery from his injuries.
Bicycle Accident Statistics
According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), 15 people were injured in Arcadia bicycle accident. In Los Angeles County as a whole, 33 deaths and 3,315 injuries were reported as a result of bicycle accidents during the same year.
What Caused This Tragic Bicycle Accident?
Based on this news report, it is not quite clear what caused this major injury bicycle accident. This particular intersection has traffic lights and clearly marked crosswalks. It is not clear, however, where the bicyclist was at the time of the car accident. Was he riding across the intersection? Was he walking his bike in a crosswalk? Did either the bicyclist or the motorist fail to yield right-of-way?
According to California Vehicle Code Section 21800 (a): “The driver of a vehicle approaching an intersection shall yield the right-of-way to any vehicle which has entered the intersection from a different highway.” Bicyclists under California law have the same rights and responsibilities as drivers of other vehicles. I trust officials are also looking into whether the van’s driver was intoxicated, distracted, speeding or otherwise negligent at the time of the car accident.
If the driver of the van is determined to have been at fault, then he or she could be held financially responsible for the injuries caused to the bicyclist. Injured victims in such cases could seek compensation to cover medical expenses, loss of wages, cost of hospitalization, rehabilitation and other related damages.
