Los Angeles Car Accident Injures Police Officer

By

Sgt. Brian Neel was injured in a Los Angeles car accident after his patrol car was struck by a driver who, officials say, made an unsafe left turn the night of October 26, 2010. According to a news report in the Los Angeles Times, the Los Angeles Sheriff’s Sergeant was southbound on La Mirada Boulevard, when he was hit by a car that made a left turn at Oakwood Lane in La Mirada. Neel had to be extricated from the police vehicle. His injuries are not believed to be life-threatening. The female driver who has not yet been identified was not injured. An investigation is ongoing.

I sympathize with Sgt. Brian Neel and hope his injuries are not serious. I wish him the very best for a speedy and complete recovery.

Car Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), one fatality and 182 injuries were reported as a result of La Mirada car accidents. In Los Angeles County as a whole 667 people died and 52,229 were injured due to car accidents during the same year.

The Law Relating to Left Turns

If the details of this news report are accurate, Sgt. Neel had the green light when he was driving south on La Mirada Boulevard. It appears that the other driver failed to yield right-of-way to the patrol vehicle. California Vehicle Code Section 21801 (a) states: “The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety.”

Claim for Compensation

If the other driver is determined to have been at fault for this car accident, she could be held financially liable for the officer’s injuries. In addition to a personal injury claim against the at-fault driver, the police officer will also be entitled to workers compensation benefits because he was injured on-the-job. Injured victims in such cases can seek compensation for medical expenses, loss of earnings, cost of hospitalization, physical therapy and other related damages. An experienced Los Angeles car accident lawyer will be able to better advise victims about their legal rights and options.
