San Francisco Bay Area Car Accident Injures Three

By

A 4-year-old boy and two adults were injured in a San Francisco area car accident, which, police report, was caused by a driver who went through a red light the morning of October 19, 2010. According to a news report in the Contra Costa Times, the injury car accident occurred at the intersection of Oakhurst Drive and Eagle Peak Avenue in Clayton. Police say that a Honda sedan driven by a Pittsburg woman in her 30s, failed to stop for a red light at the intersection and crashed into a Toyota Camry driven by a woman in her 80s. Both drivers and the 4-year-old boy, who was a passenger in the Honda, suffered moderate injuries and were treated at a nearby hospital.

Contra Costa Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), eight people were injured in Clayton car accidents. During the same year, 59 deaths and 3,621 injuries were reported as a result of car accidents in all of Contra Costa County.

The Law Relating to Red Lights

Based on this news report, the driver of the Honda drove through a red light, which is a violation of California law. It is not clear what caused this driver to run a red light. Was she intoxicated, distracted, speeding or simply trying to “beat the light?” California Vehicle Code Section 21453 (a) states: “A driver facing a circular red signal shall stop at the limit line before entering the crosswalk on the near side of the intersection or, if none, then before entering the intersection, and shall remain stopped until an indication to proceed is shown.”

Liability Issues
