Bakersfield Car Accident Causes Injuries

By

Christopher Stubendorf, 34, and his father Richard Stubendorf, 61 were seriously injured in a Bakersfield car accident on Highway 46. According to a news report in the San Jose Mercury News, the injury car accident occurred the night of November 14, 2010 on Highway 46 near Kecks Road. The two injured victims were travelling in a 2010 Mini Cooper when a 1993 Honda Accord EX collided head-on with their vehicle.

According to the police, the male driver of the Accord was attempting to pass a vehicle and failed to get back into his lane of traffic in time to avoid the collision. The two men in the Mini Cooper sustained major injuries including broken bones. The driver of the Honda sustained major injuries and was apparently taken away from the scene by relatives. But officials have located the hit-and-run driver. He is expected to face several charges in connection with this injury car accident.

My thoughts and prayers are with Christopher Stubendorf and Richard Stubendorf following this car accident. I wish them both a complete and speedy recovery from their injuries.

Kern County Car Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), 29 people were killed and 1,111 were injured in Bakersfield car accidents. During that same year, there were 103 fatalities and 3,460 injuries reported as a result of car accidents in Kern County.

What Caused This Serious Injury Accident?

According to the news account, the driver of the Honda Accord made an unsafe lane change and entered into the path of oncoming traffic. California Vehicle Code Section 21658 (a) states that whenever a roadway has been divided into two or more clearly marked lanes for traffic in one direction the vehicle “shall be driven as nearly as practical entirely within a single lane and shall not be moved from the lane until such movement can be made with reasonable safety.”

In this case, the driver of the Honda also left the scene of the accident, which is a serious crime under California Vehicle Code Section 20001 (a). It is appalling that the brother and other relatives of the Honda’s driver took all that effort to transport their loved one to the hospital, but left the two seriously injured victims at the scene to fend for themselves.

Liability Issues

If it is determined that the driver of the Honda was at fault for this car accident, he could be held liable for the injuries caused to the victims. Injured victims in such cases could seek compensation to cover medical expenses, loss of wages, cost of hospitalization, rehabilitation and other related damages. An experienced Bakersfield personal injury lawyer will be able to better advise victims and their families about their legal rights and options.
