Three Injured in Los Angeles Car Accident

By

Three people were injured in a Los Angeles car accident, which involved a car and a Los Angeles Department of Transportation bus. According to a report in the Pasadena Star-News, the injury accident occurred the morning of November 16, 2010, when a Nissan Maxima and the commuter bus struck each other near an apartment building at the intersection of Cordova Street and Madison Avenue in Pasadena. The bus driver and a passenger in the bus were transported to a local hospital as was the driver of the Nissan. The impact from the collision caused the bus to jump the curb and hit a decorative wall outside the apartment building, but there were no other injuries or damages.

It is indeed fortunate that no bystanders or passers by were seriously injured in this bus accident. I wish those who were injured the very best for a speedy and complete recovery.

Car Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), there were eight deaths and 978 injuries involving car accidents in Pasadena. In Los Angeles County as a whole, 667 people died and 52,229 were injured as a result of car accidents during the same year.

What Caused This Accident?

Based on this news report, it is not clear how or why this bus accident occurred. Who was at fault here? Did one of the vehicles run a red light at the intersection? Did one of the drivers fail to yield right-of-way? Was impairment, driver distraction or speed a factor in this car accident? I trust officials are examining these and other issues in order to determine what occurred here and why.

While we do not know at this point if the LADOT bus driver was at fault here, transportation companies – whether they are public or private carriers – can be held liable for injuries suffered in accidents involving their vehicles. California law holds transit companies to a higher standard of “utmost duty of care” that is owed to passengers. This essentially means that these transit companies bear the ultimate responsibility for the safe transport of their passengers.

According to California Vehicle Code Section 21800 (a): “The driver of a vehicle approaching an intersection shall yield the right-of-way to any vehicle which has entered the intersection from a different highway.” Running a red light is also a serious traffic violation under California Vehicle Code Section 21453 (a).

Fault and Liability

If the bus driver in this case is determined to have been at fault, then the driver and his or her employer, the transit authority, can be held liable for the accident. If the driver of the Nissan is determined to have been at fault, then he or she could be held liable for the injuries and damages caused. An experienced Los Angeles personal injury lawyer will be able to better advise injured victims and their families about their legal rights and options in such cases. Please remember that any personal injury claim against a California governmental agency must be filed within 180 days of the incident.
