Motorcycle Accident Proves Fatal for Man

Justin Olivera, 40, was killed in a car accident when his motorcycle collided with a pickup truck. According to a news report in The Chico Enterprise Record, the fatal motorcycle accident occurred the night of November 14, 2010 at the intersection of Highway 162 and Glenn County Road in Glenn County. Olivera was riding his motorcycle when a pickup truck driven by Leonard Lambert, 76, turned into his lane of traffic. Olivera was unable to avoid the truck and sustained serious injuries including a broken pelvis in the accident. He was taken to a local hospital where he died from his injuries.

Motorcycle Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), three people were killed and five were injured as a result of motorcycle accidents in the unincorporated areas of Glenn County. During the same year, there were three fatalities and seven injuries reported as a result of motorcycle accidents in all of Glenn County.

Right-of-Way Issues

Police believe that the pickup driver stopped at the stop sign at this intersection, but failed to see the approaching motorcycle. According to California Vehicle Code Section 21800 (a): “The driver of a vehicle approaching an intersection shall yield the right-of-way to any vehicle which has entered the intersection from a different highway.”

Liability Issues

If the driver in this case, Lambert, is determined to have been at fault for failing to yield right-of-way, he could be held liable for Olivera’s wrongful death. I trust officials are also looking into whether Lambert was impaired, distracted , fatigued or otherwise negligent at the time of the fatal motorcycle accident.
