Two people were injured in an Orange County car accident after two vehicles collided at a street intersection. According to a news report in The Orange County Register, the injury car accident occurred the morning of November 9, 2010 at the intersection of Magnolia Street and Orangewood Avenue in Garden Grove. Police say a Volkswagen Jetta was traveling south when the driver of a Dodge Durango ran a red light and struck the Jetta on the passenger side. Both drivers sustained head injuries, which are not life-threatening. An investigation is ongoing.
It is indeed fortunate that no one was catastrophically or fatally injured in this car accident. I wish the injured victims the very best for a speedy and complete recovery.
Car Accident Statistics
According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), there were 12 fatalities and 717 injuries involving Garden Grove car accidents. In Orange County as a whole, 152 people died and 13,414 were injured due to car accidents during the same year.
Laws Relating to Traffic Control Devices
Based on this news account, several witnesses told police that the driver of the Dodge Durango ran a red light at the intersection and caused the injury car accident. Driving through a red light is a serious offense under California law. California Vehicle Code Section 21453 (a) states: “A driver facing a circular red signal shall stop at the limit line before entering the crosswalk on the near side of the intersection or, if none, then before entering the intersection, and shall remain stopped until an indication to proceed is shown.”
Fault and Liability
I trust officials are also looking into whether the driver of the Durango was under the influence, distracted, speeding or driving recklessly at the time of the car accident. In such cases, the at-fault driver can be held financially responsible for the injuries and damages caused to the victims. Injured victims can seek compensation to cover medical expenses, loss of earnings, cost of hospitalization, rehabilitation, pain and suffering, and other related damages.
Car accident victims would also be well-advised to seek the counsel of an experienced Orange County personal injury lawyer, who will analyze all aspects of the incident and ensure that the negligent parties are held liable. A knowledgeable car accident lawyer will also be able to advise victims about how their car insurance policy might apply to an incident where the at-fault driver is uninsured or underinsured.
