Orange County Car Accident Injures Pedestrian

A man was seriously injured in an Orange County car accident after he was hit by a vehicle the evening of December 18, 2010. According to a news report in The Orange County Register, the major injury pedestrian accident occurred in the 2100 block of E. Santa Clara Avenue in Santa Ana. The pedestrian was transported to an area hospital and is on life support. The driver stopped at the scene, but has not been arrested pending an official investigation. Authorities say the driver was not under the influence.

My heart goes out to the injured pedestrian, who is apparently fighting for his life. I pray that he makes it through these critical injuries and goes on to make a complete recovery. Please keep this victim and his family in your thoughts and prayers.

Pedestrian Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), there were three fatalities and 123 injuries involving pedestrian accidents in Santa Ana. In Orange County as a whole, 31 people died and 785 were injured as a result of pedestrian accidents during the same year.

Laws Relating to Pedestrians

Based on this news report, it is not clear if the pedestrian was in a crosswalk at the time. California law requires motorists to yield right-of-way to pedestrians in marked or unmarked crosswalks. California Vehicle Code Section 21950 states: “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection.” The same section also states that the driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk “shall exercise all due care and shall reduce the speed of a vehicle or take any other action relating to the operating of the vehicle as necessary to safeguard the safety of the pedestrian.”

Police do not suspect the driver was under the influence at the time. However, I trust they are looking into whether the driver was distracted, speeding or otherwise negligent at the time.
