Ricardo Alpizar, 20, was injured in a Santa Barbara car accident, which police say, was caused by a motorist driving under the influence of drugs. According to KEYT, the bicycle accident occurred on Via Real, near Sandpiper Road in Carpinteria, the afternoon of December 9, 2010. Alpizar was on his bike when a white Volvo went off the road and hit him. The bicyclist suffered major injuries and was transported to a local hospital. The driver, Dean McAllister, 52, was arrested on suspicion of felony DUI.
My thoughts and prayers are with Ricardo Alpizar and his family for what they are going through at this time. I wish him the very best for a complete and speedy recovery from his injuries.
According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), eight people were injured in DUI collisions in Carpinteria. In Santa Barbara County as a whole, there were 19 fatalities and 287 injuries reported as a result of alcohol-related car accidents during the same year.
Drunk Driving Law
Police believe the driver of the Volvo was under the influence of drugs when the vehicle veered off the roadway and struck the bicyclist. According to California Vehicle Code Section 23152 (a): “It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle.” The same section also states that it is illegal for any motorist to operate a vehicle with a blood alcohol concentration (BAC) of 0.08 percent or higher.
Victims’ Claim for Compensation
A victim of a DUI driver can seek compensation for injuries, damages and losses by filing a personal injury claim. Such claims seek compensation to cover medical expenses, loss of wages, cost of hospitalization, rehabilitation and other related damages. An experienced California personal injury lawyer will be able to better advise injured victims in such cases about their legal rights and options.
A knowledgeable car accident attorney should also inform victims about how their own car insurance policy applies to an incident where the at-fault motorist is uninsured or underinsured.
