Woman Fatally Injured in Los Angeles Car Accident

By

Maria Casteneda-Nunez, 66, was killed in a Los Angeles car accident after she was hit by a pickup truck and an MTA bus. According to a CBS news report, the fatal pedestrian accident occurred on Central Avenue near 88th Street in South Los Angeles, the evening of December 18, 2010. The truck first collided with Casteneda-Nunez as she was crossing the street. The pedestrian was then run over by an MTA bus. The pickup truck driver who initially left the scene of the fatal injury accident turned himself in to the police. An investigation is ongoing to determine the cause of this fatal pedestrian accident.

My heartfelt condolences go out to the family and friends of Maria Casteneda-Nunez. My thoughts and prayers are with them during this difficult time.

Los Angeles Pedestrian Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), 104 people were killed and 2,716 were injured in Los Angeles pedestrian accidents. During that same year, there were 214 fatalities and 4,985 injuries as a result of pedestrian accidents in Los Angeles County.

What Caused This Fatal Car Accident?

It is not clear from the report what may have caused this car accident. Investigators are going to have to determine why the pickup truck driver struck the victim. Additionally, the authorities may choose to look into why the bus was unable to avoid the accident. It is also not clear whether the driver of the pickup truck will be charged with hit-and-run. However, the driver did the right thing by turning himself or herself over to authorities.

It is against California law for motorists to leave the scene of a car accident. California Vehicle Code Section 20001 (a) states: “The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident.”

Liability Issues

In such cases, families of deceased victims would be well-advised to seek the counsel of an experienced Los Angeles personal injury lawyer, who will stay abreast of the official investigation and make sure that the negligent parties are held liable. If the driver of the pickup truck is determined to have been at fault, he or she could be held liable for Casteneda-Nunez’s wrongful death. If the MTA bus driver is determined to have been at fault, then the driver and his or her employer could be held liable. Please remember that any personal injury or wrongful death claim against a California public entity must be filed within six months of the accident or injury.
