Motorcyclist Killed in Fresno Area Car Accident

By

A 57-year-old Clovis man was killed in a Fresno area car accident, which police say, was caused by an intoxicated driver. According to a news report in The Fresno Bee, the fatal motorcycle accident occurred the morning of December 12, 2010 on Highway 41 in Madera County. Authorities say Bruce David Faux, 49, crashed his Toyota Sienna head-on into a 2006 Suzuki motorcycle when he tried to pass a vehicle on the highway. The rider and his passenger, 53-year-old Wilma Tucker, were ejected from the motorcycle. The motorcyclist was killed in the accident, while Tucker sustained major injuries and Faux suffered minor injuries. Faux has been arrested on suspicion of second degree murder, felony DUI and gross vehicular manslaughter.

My heartfelt condolences go out to the family and friends of the man killed in this tragic motorcycle accident. My thoughts and prayers are also with Wilma Tucker as she heals from her serious injuries.

DUI Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), six people were killed and 76 injured in DUI collisions in the unincorporated areas of Madera County. Also, countywide, nine fatalities and 103 injuries were reported due to alcohol-related car accidents during the same year.

Drunk Driving Laws

Based on this news report, the driver of the Toyota Sienna was under the influence of alcohol. It is illegal to drive under the influence of alcohol and/or drugs under California Vehicle Code Section 23152 (a). A driver whose act of driving under the influence results in the death of another will likely face vehicular manslaughter charges as Faux does in this case.

California Penal Code Section 191.5 (a) states: “Gross vehicular manslaughter while intoxicated is the unlawful killing of a human being without malice aforethought, in the driving of a vehicle, where the driving was in violation of Section 23140, 23152, or 23153 of the Vehicle Code, and the killing was either the proximate result of the commission of an unlawful act, not amounting to a felony, and with gross negligence, or the proximate result of the commission of a lawful act that might produce death, in an unlawful manner, and with gross negligence.”

Liability Issues

The family of a victim killed or seriously injured in a DUI collision would be well advised to speak with an experienced Fresno personal injury lawyer, who has a successful track record holding drunk drivers financially liable. Where negligence or wrongdoing is involved, the family of a deceased car accident victim can file a wrongful death claim seeking compensation for medical and funeral expenses, lost future income, loss of love and companionship, and other related damages.
