DUI Collision in Newport Beach Kills Bicyclist

By

A bicyclist was fatally injured in a Newport Beach car accident, which police say, involved a suspected drunk driver. According to a news report in The Orange County Register, the fatal bicycle accident occurred the evening of February 21, 2011 near the intersection of San Joaquin Hills Road and Spyglass Road. Police say 22-year-old Danae Marie Miller of Newport Coast was driving under the influence when she struck the male bicyclist with her Volkswagen Jetta. Miller was arrested on suspicion of gross vehicular manslaughter while intoxicated. An investigation is ongoing.

I offer my deepest condolences to everyone who knew and loved the victim who was killed in this tragic bicycle accident. Please keep this victim’s family members and friends in your thoughts and prayers.

DUI Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), there were three deaths and 56 injuries involving DUI collisions in Newport Beach. In Orange County as a whole, 62 people died and 1,492 were injured in alcohol-related car accidents during the same year.

Drunk Driving Laws

Driving under the influence of alcohol and/or drugs is a serious crime under California Vehicle Code Section 23152 (a). A DUI driver who causes a fatal car accident, which results in the death of another, will likely be charged with gross vehicular manslaughter while intoxicated, which is a felony.

California Penal Code Section 191.5 (a) states: “Gross vehicular manslaughter while intoxicated is the unlawful killing of a human being without malice aforethought, in the driving of a vehicle, where the driving was in violation of Section 23140, 23152, or 23153 of the Vehicle Code, and the killing was either the proximate result of the commission of an unlawful act, not amounting to a felony, and with gross negligence, or the proximate result of the commission of a lawful act that might produce death, in an unlawful manner, and with gross negligence.”

Protecting Victims’ Rights

In such cases where negligence or wrongdoing is apparent, the family members of a deceased car accident victim can file a wrongful death claim against the at-fault party seeking compensation for medical and funeral expenses, lost future income and benefits, loss of love, care and companionship, and other related damages. Families of DUI car accident victims would be well-advised to seek the counsel of an experienced Newport Beach personal injury lawyer, who will stay on top of the official investigation and ensure that their legal rights and best interests are protected.
