Hit-and-Run Car Accident in San Diego Injures Motorcyclist

By

A motorcyclist, identified as Jeremy Gene Walkowiak, was seriously injured in a San Diego car accident, which officials say, involved a hit-and-run driver. According to a 10News report, the injury motorcycle accident occurred the evening of March 3, 2011 on Montiel Road in San Marcos. Police say Walkowiak was traveling east on Montiel from Nordahl Road when a vehicle turned in front of him.

Walkowiak lost control of his motorcycle. It was at that time that 61-year-old Richard William Flaig made a left turn in a Dodge pickup truck and ran over Walkowiak and his motorcycle. Eyewitnesses told police that the pickup truck did not stop and kept going. Walkowiak has been hospitalized with serious injuries. Investigators later identified Flaig as the driver of the pickup truck and arrested him on suspicion of felony hit-and-run causing injury. An investigation is ongoing.

My heart goes out to the injured victim, Jeremy Walkowiak. I sincerely hope he has not sustained catastrophic injuries in this hit-and-run car accident and pray for his speedy and complete recovery.

Motorcycle Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), one fatality and 16 injuries were reported in motorcycle accidents in San Marcos. In San Diego County as a whole, 51 people died and 1,081 were injured due to motorcycle accidents during the same year.

Hit-and-Run

Based on this news report, officials say that the driver of the pickup, Flaig, not only ran over the motorcyclist, but also drove away from the scene without stopping even to check on the victim. Appalling! I’m relieved that police were able to apprehend the hit-and-run driver in this case. It is not clear if the other driver who turned in front of Walkowiak motorcycle and caused him to fall on the roadway stopped at the scene.

Leaving the scene of an injury car accident is not only inhumane and cruel, but it is also illegal under California law. California Vehicle Code Section 20001 (a) states: “The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident.”

Protecting Victims’ Rights

Victims of hit-and-run car accidents would be well-advised to seek the counsel of an experienced San Diego personal injury lawyer, who will stay abreast of the official investigation and make sure that the victims’ legal rights and best interests are protected. A skilled car accident lawyer will also be able to inform victims about how their own car insurance policy might apply to an incident where the at-fault motorist is uninsured or underinsured.
