Joey Ramos, 27, was killed in an Orange County car accident involving a suspected drunk driver. According to a news report in The Orange County Register, the fatal motorcycle accident occurred the morning of March 19, 2011 on Westminster Boulevard at the Interstate 405 overpass in Westminster. Ramos was riding his motorcycle when a pickup truck driven by Tania Gallina, 24, struck him. Officials say Gallina drove her truck head-on into Ramos as she turned from Westminster Boulevard onto the northbound 405 onramp. Ramos died at the scene. Gallina has been arrested on suspicion of drunken driving and gross vehicular manslaughter.
My heartfelt condolences go out to the family and friends of Joey Ramos following this tragic motorcycle accident. He is described by family members as a caring and happy-go-lucky man. My thoughts and prayers are with Ramos’ family members as they grieve this terrible loss.
According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), 46 people were injured in DUI collisions in Westminster. During that same year, there were 62 fatalities and 1,492 injuries reported involving alcohol-related car accidents in Orange County.
Drunk Driving Laws
It is against the law to operate a motor vehicle under the influence of alcohol and/or drugs, under California Vehicle Code Section 23152 (a). A driver whose act of driving under the influence results in the death of another will likely face vehicular manslaughter charges. California Penal Code Section 191.5 (a) states: “Gross vehicular manslaughter while intoxicated is the unlawful killing of a human being without malice aforethought, in the driving of a vehicle, where the driving was in violation of Section 23140, 23152, or 23153 of the Vehicle Code, and the killing was either the proximate result of the commission of an unlawful act, not amounting to a felony, and with gross negligence, or the proximate result of the commission of a lawful act that might produce death, in an unlawful manner, and with gross negligence.”
In such cases, victims’ families would be well-advised to seek the counsel of a reputed Orange County motorcycle accident lawyer, who has the experience and a successful track record of holding drunk drivers financially responsible. A skilled car accident attorney should also inform families about how their own car insurance policy applies to an incident where the at-fault driver is uninsured or underinsured.
