Bicyclist Dies from Injuries Sustained in Orange County Car Accident

Marco Acuapan, 22, has died from injuries sustained in an Orange County car accident on November 17, 2010. According to a news report in The Orange County Register, Acuapan was riding westbound in a bike lane on Walnut near Browning Avenue in Tustin, when he was struck by a Ford Mustang driven by 65-year-old Renato Demartino. The driver fled the scene, but was arrested several hours later.

Acuapan suffered severe head injuries and never regained consciousness. He died the morning of April 7, 2011 from his injuries. Demartino pleaded not guilty to charges of felony hit-and-run with serious injury and making an unsafe turn or lane change and not using his head lamps at night. The District Attorney’s office is still considering whether to file additional charges following Acuapan’s death.

Bicycle Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), there were no fatalities, but 22 injuries involving bicycle accidents in Tustin. In Orange County as a whole, 10 people died and 1,087 were injured in bicycle accidents during the same year.

Based on this news report, police say Demartino not only drove recklessly, but also struck and critically injured a man and then, fled the scene of the crash. Under California law, it is illegal to leave the scene of an injury car accident. California Vehicle Code Section 20001 (a) states: “The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident.” It is not only illegal, but also inhumane, irresponsible and immoral to leave an injured person lying on the roadway.
